【摘要】：隨著生物技術(shù)的快速發(fā)展,轉(zhuǎn)基因食品已經(jīng)開始慢慢走進人們的生活,隨之而產(chǎn)生的必然是對轉(zhuǎn)基因食品安全性的關(guān)注。在食品安全問題越來越受到人們關(guān)注的今天,轉(zhuǎn)基因食品的商業(yè)化就更加受到人們的關(guān)注。轉(zhuǎn)基因食品安全性特征不同于普通的傳統(tǒng)食品,其具有危害潛在性、安全標(biāo)準(zhǔn)不確定性、致害范圍的廣泛性和后果的嚴(yán)重性、法律保障的特殊性等特征。在不可否認(rèn)全球?qū)τ谵D(zhuǎn)基因食品需求性的同時,各國政府及國際組織必須依靠構(gòu)建有效的轉(zhuǎn)基因食品法律制度體系來保障本國的轉(zhuǎn)基因食品安全。在食品領(lǐng)域?qū)D(zhuǎn)基因技術(shù)的需要是我國現(xiàn)實國情所決定的現(xiàn)實需求,隨著轉(zhuǎn)基因食品逐步推向市場,其安全性問題成為各國政府和民眾最為關(guān)心的問題。在我國的轉(zhuǎn)基因食品安全立法中究竟是采用歐盟的“風(fēng)險預(yù)防原則”還是采用美國的“無罪推定原則”,這一方面取決于我們的文化傳統(tǒng)和民眾對轉(zhuǎn)基因食品的認(rèn)知度、我國目前的生物技術(shù)水平等因素,另一方面也即更為重要的一方面就是法律制度的保障。本文先從轉(zhuǎn)基因食品的定義和內(nèi)涵著手,然后詳細地從監(jiān)管制度、標(biāo)識制度等方面簡介了歐盟、美國、日本等國家和地區(qū)的轉(zhuǎn)基因食品安全的立法實踐,在對我國目前的轉(zhuǎn)基因食品安全立法進行了簡要的介紹和分析后,指出了我國現(xiàn)有轉(zhuǎn)基因食品安全立法的不足。在分析了我國轉(zhuǎn)基因食品安全立法完善的必要性后,本文對我國的轉(zhuǎn)基因食品安全立法在借鑒他國經(jīng)驗和結(jié)合我國國情的基礎(chǔ)上,從我國轉(zhuǎn)基因食品安全風(fēng)險評估制度、轉(zhuǎn)基因食品安全標(biāo)簽制度、轉(zhuǎn)基因食品安全監(jiān)督管理制度、轉(zhuǎn)基因食品安全的救濟制度等法律制度的完善方面對我國的轉(zhuǎn)基因食品安全立法提出了幾點不成熟的建議。
[Abstract]:With the rapid development of biotechnology, genetically modified food has begun to slowly into people's lives, the attendant is to concern about the safety of genetically modified food. The food safety problem more and more attention today, the commercialization of genetically modified food. People pay more attention to the safety of genetically modified food features different from ordinary the traditional food, which has potential hazards, safety standard uncertainty, severity and consequences of the damage caused by the wide range of features, such as special legal protection. In denying the global transgenic food demand at the same time, governments and international organizations must rely on building an effective legal system of genetically modified food to protect the safety of genetically modified food. In the field of food needs of transgenic technology is decided by the practical needs of the actual situation in our country, with the turn based Because of the food market gradually, its security issues become the most concern to the government and people of all countries. In our country the genetically modified food safety legislation in the EU is the "precautionary principle" or "the principle of presumption of innocence", on the one hand, depends on our culture and public awareness of genetically modified food, factors of China's current bio technology level, on the other hand, the more important aspect is the protection of the legal system. This paper starts from the definition and connotation of genetically modified food to proceed, then detail the supervision system, identification system and other aspects of the European Union, the United States, Japan and other countries and regions. Genetically modified food safety legislation in our country, the safety of genetically modified food legislation is introduced and analyzed briefly, pointed out that China's existing genetically modified food safety legislation The defect of the method. In the analysis of the necessity of perfecting the legislation of genetically modified food safety in China, this article on China's genetically modified food safety legislation based on the experience of other countries and combining with China's national conditions, from the evaluation system of genetically modified food safety risk in our country, the safety of genetically modified food labeling system, supervision and management system of genetically modified food safety, improve the safety of genetically modified food relief system of the legal system of our country's legislation of genetically modified food safety and puts forward some suggestions for improvement.
