【摘要】：從全國(guó)各地發(fā)生的食品安全事故中，我們可能會(huì)發(fā)現(xiàn)對(duì)現(xiàn)有的食品安全事故的處理結(jié)果，大多采取的是行政和刑法兩大手段進(jìn)行處理。本文針對(duì)這些問(wèn)題，通過(guò)對(duì)缺陷食品侵權(quán)的概念、性質(zhì)、構(gòu)成要件、歸責(zé)原則的研究，同時(shí)借鑒發(fā)達(dá)國(guó)家對(duì)于食品安全的處理機(jī)制從而希望能對(duì)我國(guó)建立完善食品缺陷侵權(quán)的救濟(jì)制度和體系提出有益建議。 第一部分主要從食品缺陷的定義、構(gòu)成要件、免責(zé)事由等方面對(duì)于缺陷食品侵權(quán)的理論基礎(chǔ)進(jìn)行討論。 第二部分是對(duì)食品缺陷侵權(quán)救濟(jì)進(jìn)行民法分析，以明確食品缺陷侵權(quán)的歸責(zé)原則，從而指導(dǎo)在食品缺陷侵權(quán)案件中，以明確責(zé)任主體和責(zé)任大小。 第三部分通過(guò)對(duì)發(fā)達(dá)國(guó)家的食品缺陷侵權(quán)救濟(jì)制度的研究，借鑒優(yōu)秀的食品缺陷侵權(quán)救濟(jì)模式，不僅局限于事后補(bǔ)救，還擴(kuò)大至事前預(yù)防，確保食品從生產(chǎn)到銷售再到消費(fèi)的各個(gè)環(huán)節(jié)安全。 第四部分通過(guò)分析我國(guó)出現(xiàn)的食品安全事故中，分析現(xiàn)今我國(guó)食品缺陷侵權(quán)的現(xiàn)狀和處理方法，找到現(xiàn)今我國(guó)對(duì)食品安全事件的處理存在的缺陷和不足。 第五部分是針對(duì)第四部分的不足，結(jié)合理論分析和外國(guó)的優(yōu)秀經(jīng)驗(yàn)，對(duì)我國(guó)的食品缺陷侵權(quán)的救濟(jì)制度提出完善的建議。
[Abstract]:From the food safety accidents in various parts of the country, we may find that the results of handling the existing food safety accidents are mostly dealt with by two major means, administrative and criminal. This paper aims at these problems. Through the research on the concept, nature, constitutive elements and imputation principle of defective food tort, At the same time, using the food safety mechanism of developed countries for reference, the author hopes to put forward some useful suggestions on how to establish and perfect the relief system and system of food defect infringement in our country. The first part mainly discusses the theoretical basis of the infringement of defective food from the definition of food defect, the constitutive elements, the reasons of exemption and so on. The second part is the civil law analysis of the remedy of food defect infringement, in order to clarify the principle of imputation of food defect infringement, so as to guide in the case of food defect infringement, in order to clarify the subject of responsibility and the size of responsibility. The third part, through the research on the remedy system of food defect infringement in developed countries, draws lessons from the excellent relief mode of food defect infringement, which is not only limited to the remedy after the event, but also expanded to the prevention in advance. Ensure the safety of food from production to sales to consumption. The 4th part analyzes the present situation and treatment methods of food defect infringement in our country through analyzing the food safety accidents in our country, and finds out the defects and deficiencies in the treatment of food safety incidents in our country. The 5th part is aimed at the deficiency of 4th part, combining the theoretical analysis and the foreign excellent experience, puts forward the perfect suggestion to the relief system of the food defect infringement in our country.
