【摘要】:毋庸置疑人類要生存、發(fā)展離不開住房這一基本物質條件,這是公民實現(xiàn)生存、發(fā)展權的重要保障。1991年我國的住房改革取得了實質性的進展,通過立法和行政手段相結合的方式,逐步建立保障性住房體系。20多年來,我國孜孜不倦的探索研究,在保障性住房制度方面初見成效,但是在不斷推行保障性住房制度的今天,逐漸暴露出一些問題。如立法層次偏低,僅有兩種保障方式,即實物補貼、貨幣補貼;不公正配租程序;尚未健全首席入、退出機制。本文深入剖析了當前我國實施保障性住房制度的現(xiàn)狀,并以吉林省為例子,深入剖析了其保障性住房退出法律制度。本文除緒論和結論外一共分為五部分:第一部分,保障性住房法律制度概論。這一部分主要介紹保障性住房的含義及基本特征,重點闡述剖析了保障性住房法律制度的主要內(nèi)容及其基本含義。第二部分,剖析了吉林省保障性住房法律制度的現(xiàn)狀及存在的問題。結合現(xiàn)狀,深入剖析當前吉林省在保障性住房法律制度方面所存在的不足之處。具體表現(xiàn)為立法層級偏低,發(fā)布的政策形式多樣,缺乏統(tǒng)一標準;準入制度審查不完善,退出制度不健全等。第三部分,扼要剖析了吉林省保障性住房退出法律制度的現(xiàn)狀及存在的問題。具體表現(xiàn)為退出指標監(jiān)測困難,存在“騙租騙購”現(xiàn)象,退出模式相對單一,沒有完善的退出法律制度等。第四部分,著眼于國際,剖析了與外國家(地區(qū))在保障性住房法律制度方面所取得的成功經(jīng)驗。具體研究了美、日以及新加坡等國家,除此之外還剖析了我國香港的保障性住房退出法律制度,結合國內(nèi)經(jīng)濟發(fā)達省市的退出法律制度方面的政策制度,以期對進一步健全吉林省保障性住房退出法律制度能夠提供一定的借鑒意義。第五部分,針對上述問題,提出具體健全保障性住房退出法律制度的相關策略、方法,指出當下必須健全保障性住房退出法律制度的地方性法律法規(guī);其次,需要成立專門的退出機構保障受保障人在不符合保障條件時能夠順利退出保障性住房;再次,建立保障性住房的有效的監(jiān)管體系,并能夠實施動態(tài)監(jiān)視;第四,能夠提供多樣化的退出方式。
[Abstract]:There is no doubt that in order to survive, human beings cannot develop without housing as a basic material condition, which is an important guarantee for citizens to realize their right to survival and development. In 1991, substantial progress was made in housing reform in China. In the past more than 20 years, through the combination of legislation and administrative means, our country has worked tirelessly to explore and study the indemnificatory housing system. However, today, when we continue to implement the indemnificatory housing system, Some problems have been gradually exposed. For example, the legislative level is on the low side, and there are only two types of safeguards, namely, in-kind subsidies, monetary subsidies, unfair rent-allocation procedures, and not yet a sound chief. This paper deeply analyzes the current situation of implementing the indemnificatory housing system in China, and takes Jilin Province as an example. In addition to the introduction and conclusion, this paper is divided into five parts: the first part, the introduction of the legal system of affordable housing. This part mainly introduces the meaning and basic characteristics of affordable housing. The main content and basic meaning of the legal system of indemnificatory housing are expounded in detail. The second part analyzes the present situation and existing problems of the legal system of indemnificatory housing in Jilin Province. Deeply analyze the deficiency in the legal system of indemnificatory housing in Jilin Province at present. The concrete manifestation is that the legislative level is on the low side, the policies issued are various, lack of uniform standard, the examination of the admission system is not perfect, The third part briefly analyzes the current situation and existing problems of the legal system of affordable housing withdrawal in Jilin Province. The concrete manifestation is the difficulty of monitoring the exit index, the phenomenon of "rent fraud and purchase", and the relatively single exit mode. There is no perfect exit legal system and so on. Part 4th, focusing on the international community, analyzes the successful experience gained in the legal system of affordable housing with foreign countries (regions). It specifically studies countries such as the United States, Japan and Singapore. In addition, it also analyzes the legal system for the withdrawal of affordable housing in Hong Kong, and the policy system for withdrawing from the legal system of the economically developed provinces and cities in China. In order to further improve the legal system of indemnificatory housing withdrawal in Jilin Province can provide certain reference significance. Part 5th, in view of the above problems, put forward specific and sound legal system of affordable housing withdrawal from the relevant strategies, methods, It points out that the local laws and regulations of the legal system of the withdrawal of indemnificatory housing must be perfected at present. Secondly, it is necessary to set up a special withdrawal organization to ensure that the insured person can exit the indemnificatory housing smoothly when they do not meet the guarantee conditions. Thirdly, Establish an effective regulatory system for affordable housing and be able to implement dynamic surveillance; 4th, can provide a variety of exit methods.
