【摘要】：基本原則是核安全法律制度構(gòu)建的基礎和出發(fā)點。國際原子能機構(gòu)的出版物為識別核安全法基本原則提供了參考指引,核安全領(lǐng)域的國際法律文件確立了安全原則、許可證持有人主要責任原則、核安全獨立監(jiān)管原則、全過程控制原則、公開透明和公眾參與原則這五項基本原則,這些基本原則在國家層面的核安全立法實踐中也得到印證。我國《核安全法(草案)》征求意見稿未明確規(guī)定"全過程控制原則"和"公開透明和公眾參與原則",其確立的"獨立監(jiān)管原則"沒有在制度設計上予以保障。建議草案后續(xù)修改要完善關(guān)于原則條文的表述,納入"全過程控制原則",將信息公開和公眾參與制度安排提升至基本原則的高度,并在監(jiān)管體制上強化核安全監(jiān)管機關(guān)的獨立性。
[Abstract]:The basic principles are the basis and starting point for the construction of the legal regime on nuclear safety. The publications of the International Atomic Energy Agency provide reference guidance for the identification of the basic principles of nuclear safety law, and international legal documents in the field of nuclear safety establish safety principles. The five fundamental principles are the principle of primary responsibility of the permit holder, the principle of independent regulation of nuclear safety, the principle of full process control, the principle of openness and transparency and the principle of public participation, These basic principles have also been confirmed in the practice of nuclear safety legislation at the national level. The draft Law on Nuclear Safety in our country does not clearly specify the "principle of full process control" and the "principle of openness, transparency and public participation". The "principle of independent supervision" established by it has not been safeguarded in the design of the system. It is suggested that the following amendments of the draft should improve the formulation of the provisions of the principle. By incorporating the "whole process control principle", the system of information disclosure and public participation is promoted to the basic principle level, and the independence of the nuclear safety regulatory authority is strengthened in the regulatory system.
