【摘要】：2015年修訂的《食品安全法》為了更好地保護(hù)消費(fèi)者、保障食品安全,規(guī)定了大量的缺陷食品營銷參與者的侵權(quán)責(zé)任并合規(guī)則。缺陷食品營銷參與者,是指在缺陷食品的生產(chǎn)經(jīng)營中,為缺陷食品的生產(chǎn)經(jīng)營提供營銷支持,促成食品生產(chǎn)經(jīng)營者與消費(fèi)者達(dá)成交易的經(jīng)營者或者非經(jīng)營者。缺陷食品營銷參與者的侵權(quán)責(zé)任并合,是指在多數(shù)人侵權(quán)行為中的缺陷食品致害責(zé)任,在法律原本規(guī)定承擔(dān)一種侵權(quán)責(zé)任形態(tài)的基礎(chǔ)上,又增加規(guī)定了營銷參與者承擔(dān)其他侵權(quán)責(zé)任形態(tài)或者同一種侵權(quán)責(zé)任形態(tài),構(gòu)成更多的侵權(quán)人對(duì)同一缺陷食品造成的損害承擔(dān)不同種或者同一種侵權(quán)責(zé)任并相互重合的責(zé)任形態(tài)。在《食品安全法》規(guī)定的缺陷食品侵權(quán)責(zé)任并合中,主要是異質(zhì)并合和同質(zhì)異形并合。
[Abstract]:In 2015, the Food Safety Act was amended to better protect consumers and ensure food safety. In the production and operation of defective food, it means to provide marketing support for the production and operation of defective food and to promote the combination of tort liability of the participants in the marketing of defective food with the operator or non-operator who has entered into the transaction between the food producer and the consumer. It refers to the liability for food damage caused by defects in the tort behavior of most people. On the basis of a form of tort liability stipulated in the original law, it also stipulates that the marketing participants bear other forms of tort liability or the same form of tort liability. Constituting more infringers to bear different or identical forms of liability for damage caused by the same defective food. In the combination of tort liability for defective food under the Food Safety Law, It is mainly heterogeneity and heteromorphism.
