【摘要】：社會(huì)法的訴訟機(jī)制與社會(huì)權(quán)訴訟密切相關(guān)。社會(huì)權(quán)的發(fā)展有一個(gè)從道德權(quán)利到法律權(quán)利、從應(yīng)然權(quán)利到實(shí)然權(quán)利、從不可訴權(quán)利到可訴權(quán)利的演進(jìn)過(guò)程,由此形成并決定了社會(huì)法獨(dú)特的訴訟機(jī)制。與其他部門法相比,社會(huì)法在訴訟機(jī)構(gòu)設(shè)置、訴訟程序、訴訟機(jī)理和訴訟主體資格認(rèn)定方面有很大的不同。不僅如此,社會(huì)法上的訴權(quán)并非完全的權(quán)利,而是受到了一定限制。因?yàn)樯鐣?huì)法上的權(quán)利實(shí)現(xiàn)取決于社會(huì)發(fā)展的總體水平,不能超出社會(huì)的經(jīng)濟(jì)結(jié)構(gòu)以及由經(jīng)濟(jì)結(jié)構(gòu)所制約的社會(huì)文化發(fā)展程度。
[Abstract]:The litigation mechanism of social law is closely related to the litigation of social rights. The development of social rights has an evolutionary process from moral right to legal right, from ought right to actual right, from never actionable right to actionable right. Compared with other branch laws, the social law has great differences in the establishment of litigation institutions, the procedure, the mechanism of litigation and the qualification of litigant. The right of action in social law is not a complete right, but is limited, because the realization of the right in social law depends on the overall level of social development. Must not exceed the social economic structure and the social and cultural development level restricted by the economic structure.
