【摘要】：房屋征收涉及多方利益,既影響工業(yè)化、城市化進程以及地方經(jīng)濟的發(fā)展,又關(guān)涉到被征收人的切身利益和開發(fā)商的商業(yè)利益。《國有土地上房屋征收與補償條例》的頒布實施開啟了房屋征收工作的新紀(jì)元——在一定程度上緩和了公權(quán)力與私權(quán)利之間的矛盾,并為政府的征收實踐提供了行動指引。但現(xiàn)行房屋征收制度仍存在一定的局限性:征收行為引發(fā)的利益上的沖突和認識上的分歧仍在延續(xù),配套制度建設(shè)也還需要時間和經(jīng)驗的不斷積累。本文第一章對我國國有土地上房屋征收補償制度的理論基礎(chǔ)和實踐設(shè)計進行了簡單的分析,得出"房屋征收"不僅是對房屋的征收,還包括對房屋下國有土地使用權(quán)的收回的結(jié)論。為了保護公民的合法財產(chǎn)不受侵害,政府需對被征房屋作出公平合理的補償。第二章結(jié)合部分征收亂象分析了我國現(xiàn)行征收補償制度存在的問題:立法位階低;補償范圍窄、標(biāo)準(zhǔn)低、方式單一;征收程序規(guī)定缺失、模糊、流于形式等。第三章對法國、日本和德國三個大陸法系國家在征收補償制度設(shè)計方面的成熟做法進行了介紹,并結(jié)合我國國情提出對我國的啟示。最后一部分是對現(xiàn)行征收補償制度的改進建議,包括:制定房屋征收補償法、設(shè)置合理的征收程序和構(gòu)建完備的救濟體系。
[Abstract]:Housing expropriation involves multiple interests, affecting industrialization, urbanization and the development of the local economy, The promulgation and implementation of the regulations on Housing Collection and compensation on State-owned Land opened a new era of housing expropriation-to a certain extent, alleviated public power and compensation. The contradiction between private rights, But the current housing expropriation system still has some limitations: the conflict of interest caused by expropriation behavior and the differences of understanding are still continuing. The construction of supporting system also needs time and experience. In the first chapter of this paper, the theoretical basis and practical design of the system of expropriation and compensation for houses on state-owned land in China are simply analyzed. Drawing the conclusion that "house expropriation" is not only the expropriation of houses, but also the recovery of the right to use state-owned land under houses. The second chapter analyzes the problems existing in the current expropriation compensation system of our country: low legislative rank, narrow range of compensation, low standard, and single mode, the second chapter analyzes the problems existing in the current system of expropriation and compensation in combination with the disorder of partial expropriation, the scope of compensation is narrow, the standard is low, and the mode is single. The third chapter introduces the mature practices in the design of expropriation compensation system in France, Japan and Germany. The last part is about the improvement of the current expropriation and compensation system, including the establishment of housing expropriation and compensation law, the establishment of reasonable expropriation procedures and the construction of a complete relief system.
