農(nóng)村集體土地發(fā)展權(quán)權(quán)利歸屬之探究

【摘要】:我國的農(nóng)村集體土地發(fā)展權(quán)是指農(nóng)村集體土地所有者對其所有的土地最大價值利用的權(quán)利,即改變農(nóng)村集體土地使用性質(zhì)或利用強度以及直接進入土地一級市場而獲得更高土地收益的一種財產(chǎn)權(quán),但農(nóng)村集體土地發(fā)展權(quán)并不是一項獨立的權(quán)利類別,而是土地所有權(quán)的使用權(quán)能的具體表現(xiàn)形式。目前,我國關(guān)于農(nóng)村集體土地發(fā)展權(quán)的規(guī)定還處于空白狀態(tài),而在現(xiàn)實中農(nóng)村集體土地發(fā)展權(quán)實際上是掌握在國家手里的,從而所產(chǎn)生的發(fā)展權(quán)利益也由國家占有,這在很大的程度上侵害了土地所有者農(nóng)民集體的利益,致使農(nóng)村集體土地發(fā)展權(quán)的歸屬問題在農(nóng)村社會中引起很大的反響。農(nóng)村集體土地發(fā)展權(quán)衍生于農(nóng)村集體土地所有權(quán)是對土地所有權(quán)權(quán)能的分割而產(chǎn)生,理論上應(yīng)歸屬于土地的所有權(quán)主體農(nóng)民集體所有,但是,由于農(nóng)民集體是人民公社解體后的遺留問題,在制度設(shè)計上存在缺陷,農(nóng)民集體不屬于嚴格意義上法律主體,其所有權(quán)權(quán)能也受到很程度上的限制,使得農(nóng)民集體的土地發(fā)展權(quán)利益很難得以實現(xiàn),最終損害了農(nóng)民的財產(chǎn)利益。因此,需對我國現(xiàn)行法律制度進行修正,以完善農(nóng)民集體的法律地位以及所有權(quán)權(quán)能,使得農(nóng)民集體確實充分的享受到農(nóng)村集體土地發(fā)展權(quán)利益。
[Abstract]:The rural collective land development right in China refers to the right of the rural collective land owners to use the maximum value of the land owned by them. That is, a property right to change the nature or intensity of collective land use in rural areas and to gain higher land income by directly entering the land market, but the right to rural collective land development is not an independent category of rights, It is the concrete manifestation of the right to use land ownership. At present, the provisions on the right to development of rural collective land are still blank in our country. In reality, the right to development of rural collective land is actually held in the hands of the state. The resulting benefits of the right to development are also owned by the State, which to a large extent infringes on the collective interests of landowners and farmers, The ownership of the rural collective land development right causes great repercussions in the rural society. The rural collective land development right derived from the rural collective land ownership is the division of the land ownership power. In theory, it should belong to the owner of the land, the collective ownership of the peasants. However, because the collective of the peasants is a problem left behind after the disintegration of the people's commune, and there are defects in the system design, the collective of the peasants does not belong to the legal subject in the strict sense. The power of ownership is also restricted to a great extent, which makes it difficult to realize the interests of the peasants' collective land development right and damages the property interests of the peasants. Therefore, it is necessary to amend the current legal system of our country. In order to perfect the legal status and the ownership power of the peasant collective, the peasant collective can really enjoy the benefit of the rural collective land development right.
