網(wǎng)絡(luò)餐飲平臺(tái)法律監(jiān)管的困境及其治理

【摘要】:網(wǎng)絡(luò)餐飲交易平臺(tái)是隨著互聯(lián)網(wǎng)技術(shù)發(fā)展起來(lái)的新型交易方式,它吸納互聯(lián)網(wǎng)的網(wǎng)絡(luò)外部效應(yīng),可以消除信息不對(duì)稱,降低交易成本。但由于網(wǎng)絡(luò)交易的獨(dú)特性,又形成了另外一個(gè)層面的信息不對(duì)稱,導(dǎo)致新的監(jiān)管困境。在網(wǎng)絡(luò)餐飲交易平臺(tái)的監(jiān)管中,應(yīng)回歸交易的本質(zhì)屬性,從信息和成本兩個(gè)變量出發(fā),統(tǒng)合不同的食品安全治理主體,構(gòu)建社會(huì)共治格局下的網(wǎng)絡(luò)餐飲平臺(tái)治理機(jī)制�;诰W(wǎng)絡(luò)交易平臺(tái)的信息優(yōu)勢(shì)和資源優(yōu)勢(shì),劃分政府監(jiān)管與平臺(tái)監(jiān)管的界限;創(chuàng)新平臺(tái)與平臺(tái)入駐者的責(zé)任承擔(dān)方式;發(fā)揮消費(fèi)者的信息優(yōu)勢(shì),使消費(fèi)者轉(zhuǎn)化為新型的治理主體。結(jié)合一些地方的立法狀況,應(yīng)當(dāng)在規(guī)則設(shè)計(jì)中進(jìn)一步細(xì)化相關(guān)規(guī)定,增強(qiáng)制度的可實(shí)施性。
[Abstract]:The online catering trading platform is a new type of transaction mode with the development of Internet technology. It absorbs the network external effect of the Internet, which can eliminate the information asymmetry and reduce the transaction cost. However, because of the uniqueness of the network transaction, In the supervision of online catering trading platform, we should return to the essential attributes of transaction, starting from the two variables of information and cost. Integrating different main bodies of food safety governance, constructing the governance mechanism of online catering platform under the pattern of social co-governance. Based on the advantages of information and resources of the network trading platform, the limits of government supervision and platform supervision are divided. Innovation platform and the responsibility of the platform occupants, giving full play to consumers' information advantages, making consumers become new types of governance subjects. Combined with the legislative situation in some places, the relevant regulations should be further refined in the design of rules, Enhancing the enforceability of the system.
