【摘要】：行政制度實(shí)踐是檢驗(yàn)行政法學(xué)理論基礎(chǔ)的唯一標(biāo)準(zhǔn)。據(jù)此標(biāo)準(zhǔn),"政府法治論"在我國當(dāng)下行政法學(xué)理論基礎(chǔ)"各說"中最具實(shí)踐價(jià)值和實(shí)踐理性。行政制度實(shí)踐指導(dǎo)性和高度契合性賦予"政府法治論"以實(shí)踐理性;行政制度實(shí)踐適應(yīng)性是"政府法治論"實(shí)踐價(jià)值的前提;在行政制度實(shí)踐中不斷完善是"政府法治論"得以發(fā)揚(yáng)光大的基礎(chǔ);行政制度實(shí)踐延展性是"政府法治論"的生命力所在。隨著"政府法治論"理論自洽性的不斷增強(qiáng),"向行政實(shí)踐進(jìn)發(fā)"應(yīng)該成為其將來走向,以使其在"理論自信"的基礎(chǔ)之上,進(jìn)一步通過挖潛制度價(jià)值來樹立和拓展"制度自信"。
[Abstract]:The practice of administrative system is the only standard to test the theoretical basis of administrative law. According to this criterion, the theory of government ruling by law is the most practical value and practical reason in the theoretical basis of administrative law in China. The guidance and highly consistent nature endow "the theory of government ruling by law" with practical rationality; The adaptability of administrative system practice is the premise of the practical value of the "government rule of law", and the continuous improvement in the practice of administrative system is the basis on which the "government rule of law" can be carried forward. The extension of the practice of administrative system is the vitality of "the theory of government ruling by law". With the increasing self-consistency of the theory of "the theory of government ruling by law", "advancing to administrative practice" should become its future trend. On the basis of "theoretical confidence", we can further establish and expand "institutional confidence" by tapping the potential of institutional value.
