【摘要】：《環(huán)境保護(hù)法》第65條納入新的環(huán)境侵權(quán)責(zé)任承擔(dān)主體,實(shí)質(zhì)上是對"污染者負(fù)責(zé)"之環(huán)境侵權(quán)原則的突破,形成了環(huán)境責(zé)任的社會化。探討本條文之正當(dāng)性后發(fā)現(xiàn),環(huán)境服務(wù)第三方機(jī)構(gòu)與污染方不成立環(huán)境共同侵權(quán),雖然是多因一果多數(shù)人侵權(quán)的一種,但與《侵權(quán)責(zé)任法》第12條之按份責(zé)任又有沖突,通過衡量受害人求償不能之風(fēng)險(xiǎn)與機(jī)構(gòu)承擔(dān)全部中間責(zé)任之合理性,政策考量下規(guī)制為連帶責(zé)任;內(nèi)部責(zé)任份額分擔(dān),機(jī)構(gòu)以注意義務(wù)為標(biāo)準(zhǔn)適用過錯(cuò)推定原則,承擔(dān)不超過25%的責(zé)任。
[Abstract]:Article 65 of the Environmental Protection Law is a breakthrough of the environmental tort principle of "polluter responsible" by incorporating the new subject of environmental tort liability. After discussing the legitimacy of this article, it is found that environmental service third-party organizations and polluters do not establish environmental joint infringement, although it is a kind of infringement of the majority of people. However, there is a conflict with Article 12 of the Tort liability Law. By measuring the risk that the victim can not claim compensation and the rationality of the institution to bear all the intermediate responsibilities, the regulation is joint and several liability under the policy consideration. The share of internal liability is shared, the institution applies the principle of presumption of fault according to the standard of duty of care, and bears no more than 25% liability.
