【摘要】：上個(gè)世紀(jì)80年代,我國(guó)經(jīng)濟(jì)飛速發(fā)展,城市化進(jìn)程逐步加快,但與經(jīng)濟(jì)、社會(huì)發(fā)展相適應(yīng)的現(xiàn)代城市管理行政執(zhí)法體制尚未確立,有的只是從計(jì)劃經(jīng)濟(jì)時(shí)期一直延續(xù)下來的多部門各自執(zhí)法的體制,然而這樣老舊的體制不僅導(dǎo)致執(zhí)法工作中多頭執(zhí)法、重復(fù)處罰等問題層出不窮,而且城市管理的效率也得不到提高。針對(duì)這樣的現(xiàn)實(shí),以提高行政執(zhí)法效率、規(guī)范行政執(zhí)法行為等為目的的相對(duì)集中行政處罰權(quán)制度應(yīng)運(yùn)而生。自1997年北京市宣武區(qū)首次開展城市管理綜合行政執(zhí)法試點(diǎn)工作以來,至今全國(guó)已有600多個(gè)城市正在逐步推行這個(gè)制度。從其執(zhí)法效果上來看,已經(jīng)初步解決了多頭執(zhí)法、重復(fù)處罰、執(zhí)法擾民等問題,但是在城市管理行政執(zhí)法體制本身不完善、社會(huì)現(xiàn)實(shí)環(huán)境不斷變化等因素的影響下,暴力執(zhí)法、暴力抗法、腐敗等問題嚴(yán)重影響著城市管理行政執(zhí)法工作的開展,并使執(zhí)法人員與管理相對(duì)人之間的矛盾成為社會(huì)的焦點(diǎn)。而近來由城市管理行政執(zhí)法工作引起的群發(fā)性事件讓我們不得不重視這其中存在的問題,并找到引發(fā)這些問題的原因,同時(shí)更重要的是要找出解決這些問題的途徑,使城市管理行政執(zhí)法體制逐步實(shí)現(xiàn)規(guī)范化。 本文在對(duì)城市管理行政執(zhí)法工作存在的執(zhí)法效率不高、暴力執(zhí)法與暴力抗法現(xiàn)象并存、執(zhí)法腐敗普遍存在等問題進(jìn)行較系統(tǒng)闡述的基礎(chǔ)上,結(jié)合試點(diǎn)工作的經(jīng)驗(yàn)及相關(guān)專家提出的對(duì)策建議,針對(duì)法律不健全、相關(guān)管理機(jī)制不健全等原因,提出了建立健全法律法規(guī)、完善機(jī)制、強(qiáng)化執(zhí)法人員素質(zhì)培訓(xùn)等具有可行性的對(duì)策,希望能對(duì)規(guī)范我國(guó)城市管理行政執(zhí)法體制起到一定的作用。
[Abstract]:In -20s, China's rapid economic development, the process of urbanization gradually accelerated, but with the economic and social development of modern urban management law enforcement system has not been established. There is only a multi-sector law enforcement system which has been inherited from the planned economy period. However, such an old system not only leads to the law enforcement work, repeated punishment and other problems emerge in endlessly. And the efficiency of urban management can not be improved. In view of this reality, to improve the efficiency of administrative law enforcement. The system of relatively centralized administrative punishment has emerged as the times require for the purpose of standardizing administrative law enforcement. Since 1997, Beijing Xuanwu District has carried out the pilot work of comprehensive administrative law enforcement of urban management for the first time. So far, more than 600 cities across the country are gradually implementing this system. Judging from the effectiveness of its law enforcement, the problems of multiple enforcement, repeated punishment, and harassment of the people have been preliminarily solved. However, under the influence of such factors as the imperfection of the administrative law enforcement system of urban management and the changing social environment, violent law enforcement and violent resistance to the law. Corruption and other problems seriously affect the development of urban management and administrative law enforcement. And make the contradiction between law enforcement personnel and management relative person become the focus of the society, and recently by the urban management administrative law enforcement work caused by mass incidents, we have to pay attention to the existing problems. At the same time, it is more important to find out the ways to solve these problems so that the administrative law enforcement system of urban management can be standardized step by step. On the basis of systematical exposition of the problems such as low efficiency of law enforcement in urban management administrative law enforcement, coexistence of violent law enforcement and violence against law, and widespread corruption of law enforcement, etc. Combined with the experience of the pilot work and the relevant experts put forward countermeasures and suggestions, in view of the imperfect law, related management mechanism and other reasons, put forward to establish and perfect laws and regulations, perfect mechanism. It is hoped that strengthening the quality training of law enforcement personnel will play a certain role in standardizing the administrative law enforcement system of urban management in China.
