【摘要】：自1950年提出交通事故責(zé)任之鑒定至今已近六十年，尤其是二十一世紀(jì)后，交通事故認(rèn)定得到了快速發(fā)展，各地都依據(jù)相關(guān)法律法規(guī)制定了針對不同地區(qū)的實(shí)施條例和細(xì)則。但是，在實(shí)踐中還存在很多問題，人們甚至專業(yè)人士對交通事故認(rèn)定等概念及法律性質(zhì)認(rèn)識仍然不清，交通事故認(rèn)定書在司法程序環(huán)節(jié)作為證據(jù)使用存在很多弊端，交通事故認(rèn)定環(huán)節(jié)中相關(guān)檢驗(yàn)鑒定工作不規(guī)范，電動自行車因國標(biāo)登記檢驗(yàn)保險等環(huán)節(jié)的突出問題而使得事故認(rèn)定存在困境等等。作者認(rèn)為，，這些問題是社會經(jīng)濟(jì)高速發(fā)展變化帶來的，是在立體交通時代與時俱進(jìn)產(chǎn)生的新挑戰(zhàn)，需要不斷因勢利導(dǎo)的完善與解決。 本文從交通事故認(rèn)定相關(guān)概念評析入手，通過對交通事故認(rèn)定的特征、交通事故認(rèn)定等方面的法律定性、交通事故認(rèn)定在民事和刑事方面的作用、立法現(xiàn)狀和認(rèn)定原則、存在問題及其完善等方面詳細(xì)的闡述以求對我國交通事故認(rèn)定制度做一個全面解讀。
[Abstract]:Since 1950, it has been nearly 60 years since the identification of traffic accident liability, especially after 21th century, traffic accident identification has been rapid development. According to the relevant laws and regulations, all localities have formulated regulations and rules for the implementation of different regions. However, there are still many problems in practice. People, even professionals, are still not clear about the concept and legal nature of traffic accident identification, and there are many drawbacks in the use of the traffic accident identification document as evidence in the judicial procedure. The related inspection and appraisal work in traffic accident identification link is not standard, the electric bicycle because of the national standard registration inspection insurance and so on link prominent question causes the accident confirmation to exist the difficulty and so on. The author thinks. These problems are brought about by the rapid development of social economy and new challenges arising from the development of the times of three-dimensional transportation, which need to be improved and solved constantly in accordance with the situation. This article from the traffic accident cognizance related concept appraisal, through to the traffic accident confirmation characteristic, the traffic accident confirmation and so on aspect legal nature, the traffic accident confirmation in the civil and the criminal aspect function. In order to make a comprehensive interpretation of the system of traffic accident in our country, the present situation of legislation, the principle of cognizance, the existing problems and their perfection are elaborated in detail.
