【摘要】：環(huán)境侵權(quán)行為通常影響范圍廣,涉及人數(shù)多,持續(xù)時間長,對受害人的影響也是復(fù)雜且嚴(yán)重的,我國現(xiàn)行的法律法規(guī)已經(jīng)無法滿足對受害人救濟(jì)的要求。環(huán)境侵權(quán)損害公共補(bǔ)償基金制度是一種以政府為主導(dǎo)并提供部分資金,由潛在的污染企業(yè)提供資金,通過多種社會化方式籌集基金的社會化救濟(jì)方式,受害人在尋求普通民事救濟(jì)求償不能,又無法通過其他手段彌補(bǔ)損害,才能將申請材料提交至有關(guān)部門進(jìn)行評估。而環(huán)境侵權(quán)損害公共補(bǔ)償制度的建立能夠和侵權(quán)行為法共同形成一個對環(huán)境侵權(quán)受害人救濟(jì)的完善系統(tǒng)。本文運(yùn)用了文獻(xiàn)歸納法、概念分析法、比較分析法和經(jīng)濟(jì)分析法等,通過分析我國環(huán)境侵權(quán)救濟(jì)的現(xiàn)狀以及該制度建立的必要性和可行性,并通過分析建立環(huán)境侵權(quán)損害公共補(bǔ)償基金制度的理論基礎(chǔ)以及與其他相關(guān)名稱的對比明確了該制度的內(nèi)涵。最后從美國超級基金法的實(shí)施中借鑒相關(guān)經(jīng)驗(yàn),結(jié)合我國具體國情構(gòu)建了適用于我國的環(huán)境侵權(quán)損害公共補(bǔ)償基金制度。環(huán)境侵權(quán)損害公共補(bǔ)償基金制度在美國已有相關(guān)嘗試。目前我國并沒有環(huán)境侵權(quán)損害公共補(bǔ)償基金相關(guān)制度,因此本文著力于通過對該制度的深入研究,為我國建立相關(guān)制度提供具體參考。
[Abstract]:Environmental violations usually affect a wide range, involving a large number of people, long duration, the impact on victims is also complex and serious. The current laws and regulations of our country can no longer meet the requirements of relief to the victims. The public compensation fund system for environmental tort damage is a kind of government-led and provides some funds, which is funded by potentially polluting enterprises. Through a variety of socialized ways to raise funds for social relief, victims can not seek ordinary civil relief claims, and can not make up for the damage through other means. And the establishment of public compensation system for environmental tort damage can form a perfect system of relief to the victims of environmental tort together with the tort law. Literature induction. Concept analysis, comparative analysis and economic analysis, through the analysis of the current situation of environmental tort relief and the necessity and feasibility of the establishment of the system. By analyzing the theoretical basis of establishing the public compensation fund system for environmental tort damage and comparing it with other related names, this paper clarifies the connotation of the system. Finally, it draws lessons from the relevant experience in the implementation of the super fund law of the United States. This paper constructs the public compensation fund system of environmental tort damage suitable for our country according to the specific conditions of our country. The public compensation fund system for environmental tort damage has been tried in the United States. At present, there is no public compensation fund system for environmental tort damage in China. The related system of total compensation fund. Therefore, this paper focuses on the in-depth study of the system to provide a specific reference for the establishment of relevant systems in China.
