業(yè)主知情權(quán)的法律保護研究

【摘要】:近年來,我國有關(guān)業(yè)主知情權(quán)糾紛案件數(shù)量不斷增長,此類案件由于涉及群眾切身利益,社會各界均給予高度關(guān)注。業(yè)主知情權(quán)保護存在很多問題,如業(yè)主知情權(quán)范圍不清晰,知情權(quán)相關(guān)義務(wù)主體缺乏相應(yīng)的監(jiān)督制度、知情權(quán)糾紛事后救濟渠道不完善等等,只有真正解決上述各項問題,業(yè)主知情權(quán)才能得到全面有效的保護。本文嘗試通過對業(yè)主知情權(quán)保護問題的現(xiàn)狀分析找到問題根源,在弱化對抗的基礎(chǔ)上,兼顧立法和制度兩個層面為保護業(yè)主知情權(quán)提出解決方案。在立法方面建議確立主委員會的法律地位,構(gòu)建業(yè)主知情權(quán)相關(guān)義務(wù)主體的監(jiān)督體制;在制度設(shè)計層面建議物業(yè)管理合同實行酬金制并引入第三方評估監(jiān)理制度,在保護業(yè)主知情權(quán)的同時推動物業(yè)管理制度的完善。論文在對業(yè)主知情權(quán)的概念、內(nèi)容進行界定的基礎(chǔ)上,對我國業(yè)主知情權(quán)的現(xiàn)狀及問題進行分析和探討,提出對我國業(yè)主知情權(quán)保護的完善建議。論文分為以下四個部分:第一部分:業(yè)主知情權(quán)典型案例分析。通過對上海市2013年“黃漢慶訴中原證券大廈業(yè)主委員會、上海華鶯物業(yè)管理公司業(yè)主知情權(quán)糾紛案”的評述,總結(jié)出業(yè)主知情權(quán)保護存在的普遍問題。第二部分:業(yè)主知情權(quán)的內(nèi)涵與外延。通過對業(yè)主知情權(quán)概念和范圍界定,探討業(yè)主知情權(quán)的基本內(nèi)容及相關(guān)主體,特別是互聯(lián)網(wǎng)背景下業(yè)主知情權(quán)的新變化,為下一章研究提供理論基礎(chǔ)。但是業(yè)主知情權(quán)的行使也有都有限度和邊界,對強調(diào)業(yè)主知情權(quán)進行保護的同時應(yīng)確保業(yè)主委員會和物業(yè)服務(wù)企業(yè)的正常運行。第三部分:業(yè)主知情權(quán)保護的現(xiàn)狀和實務(wù)中存在的問題分析。結(jié)合司法實踐中的相關(guān)案例的剖析,分析總結(jié)出業(yè)主知情權(quán)的保護現(xiàn)狀和存在的諸多問題。第四部分:完善業(yè)主知情權(quán)保護的對策與建議。在立法上建議將消費者權(quán)益保護法的理念引入對業(yè)主知情權(quán)的保護,完善相關(guān)物業(yè)管理立法;在制度設(shè)計方面,筆者建議在物業(yè)管理中推行物業(yè)管理酬金制并嘗試引入第三方評估監(jiān)理機制。
[Abstract]:In recent years, the number of disputes about owners' right to know has been increasing in our country. Due to the vital interests of the masses, all sectors of society pay great attention to it. There are many problems in the protection of owners' right to know. If the scope of the owner's right to know is not clear, the relevant obligations of the right to know lack of a corresponding supervision system, the right to know disputes after the relief channels are not perfect, only to truly solve the above problems. The owner's right to know can be fully and effectively protected. This paper tries to find out the root of the problem by analyzing the current situation of the protection of owner's right to know, and on the basis of weakening confrontation. In the aspect of legislation, it is suggested that the legal status of the main committee should be established and the supervision system of the owner's obligation related to the right to know should be established. In the aspect of system design, it is suggested that the property management contract should implement the system of remuneration and introduce the third party evaluation supervision system to protect the owner's right to know and to promote the perfection of the property management system at the same time. This paper is about the concept of the owner's right to know. On the basis of defining the content, this paper analyzes and discusses the current situation and problems of the owner's right to know in our country. The paper is divided into four parts: the first part: the typical case analysis of the owner's right to know. Through the 2013 of Shanghai. Huang Hanqing v. owners Committee of Zhongyuan Securities Building. Comments on the dispute of the owner's right to know in Shanghai Huaying property Management Company. The second part: the connotation and extension of the owner's right to know. Through defining the concept and scope of the owner's right to know, the basic content and relevant subjects of the owner's right to know are discussed. Especially the new changes of owner's right to know under the background of Internet provide the theoretical basis for the next chapter. But the exercise of owner's right to know also has limits and boundaries. The protection of owners' right to know should be carried out while ensuring the normal operation of owners' committees and property service enterprises. Part III:. The current situation of owner's right to know and the existing problems in practice. Combined with the analysis of relevant cases in judicial practice. Analyze and summarize the current situation and problems of owner's right to know. Part 4th:. Improve the protection of owners' right to know countermeasures and suggestions. In legislation, the idea of consumer rights and interests protection law should be introduced to the protection of owners' right to know. Perfecting the legislation of property management; In the aspect of system design, the author suggests to carry out the system of property management gratuity and try to introduce the third party evaluation supervision mechanism.
