【摘要】：摘要：隨著我們這個(gè)社會(huì)變革和轉(zhuǎn)型的加速,突發(fā)事件已經(jīng)成為我們這個(gè)時(shí)代生活的一部分。應(yīng)對(duì)突發(fā)事件不僅僅是對(duì)政府能力的考驗(yàn),也是對(duì)法治的考驗(yàn)。在法治中國(guó)的進(jìn)程中,實(shí)現(xiàn)非常狀態(tài)下的法治,我們?nèi)沃氐肋h(yuǎn)。如何更好的規(guī)制緊急狀態(tài)下的行政緊急權(quán)力,是對(duì)我們法治完備程度的考量。 本文以比例原則為主線,分析了行政緊急權(quán)力特點(diǎn)、對(duì)其進(jìn)行規(guī)制的必要性,比例原則對(duì)其行使的具體要求。同時(shí)筆者也分析了域外的有關(guān)緊急權(quán)力的相關(guān)規(guī)定。最后筆者結(jié)合我國(guó)現(xiàn)有法律規(guī)定從比例原則的視角出發(fā),提出對(duì)行政緊急權(quán)力進(jìn)行規(guī)制的建議。 文本除去引言和最后的結(jié)論共四部分,文章結(jié)構(gòu)如下： 第一部分分別闡釋了突發(fā)事件和行政緊急權(quán)力的含義,分析了其特點(diǎn),并對(duì)與行政緊急權(quán)力密切相關(guān)的概念——緊急狀態(tài)進(jìn)行了分析。 第二部分介紹了有關(guān)比例原則的內(nèi)涵,對(duì)《突發(fā)事件應(yīng)對(duì)法》中的比例原則做了剖析,并根據(jù)行政緊急權(quán)力的特點(diǎn),結(jié)合實(shí)例論證了對(duì)行政緊急權(quán)力進(jìn)行規(guī)制的必要性。 第三部分論證了在突發(fā)事件應(yīng)對(duì)中比例原則對(duì)行政緊急權(quán)力的具體要求。 第四部分筆者在前面分析論證的基礎(chǔ)上提出了比例原則對(duì)行政緊急權(quán)力法律規(guī)制的運(yùn)行與完善。
[Abstract]:Absrtact: with the acceleration of social change and transformation, unexpected events have become a part of our life in this era. Dealing with emergencies is not only a test of the government's ability. It is also a test of the rule of law. In the process of ruling by law in China, we have a long way to go to realize the rule of law in an extraordinary state. How to better regulate the administrative emergency power under the state of emergency. It is a measure of the completeness of our rule of law. Based on the principle of proportionality, this paper analyzes the characteristics of administrative emergency power and the necessity of regulating it. At the same time, the author also analyzes the relevant provisions of the extraterritorial emergency power. Finally, the author combines the existing legal provisions of our country from the perspective of the principle of proportionality. This paper puts forward some suggestions on the regulation of administrative emergency power. Apart from the introduction and the final conclusion, the text consists of four parts. The structure of the article is as follows: The first part explains the meaning of emergency and administrative emergency power, analyzes its characteristics, and analyzes the concept of emergency, which is closely related to administrative emergency power. The second part introduces the connotation of the principle of proportion, analyzes the principle of proportion in the Emergency response Law, and according to the characteristics of the administrative emergency power. The necessity of regulating the administrative emergency power is demonstrated by examples. The third part demonstrates the specific requirements of the principle of proportion in emergency response to administrative emergency power. On the basis of the above analysis and argumentation, the author puts forward the operation and perfection of the principle of proportionality to the legal regulation of the administrative emergency power.
