【摘要】：環(huán)境問題是人類迄今為止面臨的最為嚴(yán)重的問題之一,1972年聯(lián)合國人類環(huán)境會(huì)議上“環(huán)境保護(hù)”作為明確的概念被提出來。我國也在經(jīng)過長期努力后,于1989年制訂的《中華人民共和國環(huán)境保護(hù)法》(下文簡稱舊法),并在2014年4月24日通過了全面修改。新修訂的《中華人民共和國環(huán)境保護(hù)法》(簡稱新法)修改幅度很大,其中對政府環(huán)境責(zé)任的規(guī)定更加詳細(xì)。政府的環(huán)境責(zé)任完善是實(shí)現(xiàn)環(huán)境善治的一個(gè)重要環(huán)節(jié),《環(huán)境保護(hù)法》修訂案中有關(guān)政府環(huán)境責(zé)任的規(guī)定,既重視了政府在環(huán)境保護(hù)方面的積極職責(zé),即積極履行服務(wù)、監(jiān)督管理等;也強(qiáng)調(diào)了政府的消極責(zé)任,即沒有履行環(huán)境職責(zé)的不利法律后果。是我國在環(huán)境法治中吸取的經(jīng)驗(yàn)教訓(xùn)的總結(jié),具有很強(qiáng)的針對性。本文主要基于對新《環(huán)境保護(hù)法》中對政府責(zé)任的規(guī)定進(jìn)行政府的環(huán)境責(zé)任問題研究,通過中外法律的不同規(guī)定對政府的問責(zé)制度進(jìn)行全面分析,并對政府環(huán)境責(zé)任的完善提出幾點(diǎn)建議。
[Abstract]:Environmental problem is one of the most serious problems faced by mankind so far. In 1972, the United Nations Conference on the Human Environment was put forward as a clear concept of environmental protection. The Environmental Protection Law of the people's Republic of China (hereinafter referred to as the old law) enacted in 1989. In April 24th 2014, a comprehensive revision was adopted. The newly revised Environmental Protection Law of the people's Republic of China (abbreviated as the New Law) was amended by a very large margin. The perfection of government environmental responsibility is an important link to achieve good governance of the environment. It not only attaches importance to the positive responsibilities of the government in environmental protection, that is, to actively perform the service, supervision and management, and so on; It also emphasizes the negative responsibility of the government, that is, the adverse legal consequences of failing to perform environmental duties. It is a summary of the experience and lessons learned in the environmental rule of law in our country. This article is mainly based on the new "Environmental Protection Law" on the provisions of government responsibility for environmental responsibility of the government research. This paper makes a comprehensive analysis of the accountability system of the government through the different provisions of Chinese and foreign laws, and puts forward some suggestions for the perfection of the government's environmental responsibility.
