【摘要】：作為藏區(qū)傳統(tǒng)法律文化,"賠命價"習(xí)慣在藏區(qū)實際起著調(diào)整人們處理命案沖突,規(guī)范人們行為的作用。但是在中國的刑事法律體系中,由于該習(xí)慣與現(xiàn)行刑法基本原則相悖進而處于被排斥的狀態(tài)。然而,隨著刑法價值的不斷深化,它所體現(xiàn)的排斥死刑、輕刑化、對受害方利益的關(guān)注和對犯罪破壞的社會關(guān)系的修復(fù)等思想與價值取向以及有效終結(jié)沖突的社會功效,與現(xiàn)代刑事法治發(fā)展趨勢具有契合之處,從而為刑法和習(xí)慣的良性互動提供發(fā)展思路。
[Abstract]:As the traditional legal culture of Tibetan area, the habit of "loss of life price" plays an important role in adjusting people to deal with homicide conflicts and standardizing people's behavior in Tibetan areas. However, in the criminal legal system of China, because this habit is contrary to the basic principles of the current criminal law, it is in a state of exclusion. However, with the deepening of the value of criminal law, it embodies the thought and value orientation of excluding the death penalty, light punishment, paying attention to the interests of the injured party and repairing the social relations destroyed by the crime, as well as the social effect of effectively ending the conflict. It coincides with the development trend of modern criminal rule of law, so as to provide development ideas for the benign interaction between criminal law and habit.
