【摘要】：單位是特殊的刑法犯罪主體。我國刑法規(guī)定，對單位犯罪適用“單罰制”與“雙罰制”相結(jié)合的刑罰原則。無論采用何種原則，單位中的責(zé)任人員都需要為其犯罪行為承擔(dān)刑事責(zé)任。鑒于責(zé)任人員在單位犯罪中的重要作用，本文擬從五個方面對單位犯罪中責(zé)任人員的相關(guān)問題進(jìn)行探討。 首先，本文分別闡述了刑法學(xué)界關(guān)于單位犯罪中責(zé)任人員承擔(dān)刑事責(zé)任的兩大學(xué)說及各方觀點，旨在辯明《刑法》對責(zé)任人員科處刑罰的理論依據(jù)。然后，分析了兩類責(zé)任人員共同的特征以及他們不同的認(rèn)定標(biāo)準(zhǔn)。接著，為了更好地定義這兩類主體，文章又對二者之間的區(qū)別進(jìn)行簡要比較，并結(jié)合案例對二者之間的關(guān)系問題進(jìn)行了分析，還比較了責(zé)任人員與自然人、責(zé)任人員相互之間在刑罰裁量上的不同處刑原則。最后，文章就與責(zé)任人員有關(guān)的一些刑法疑難問題進(jìn)行了探討。 單位犯罪是刑法學(xué)研究的熱點問題，對責(zé)任人員相關(guān)問題的研究只是其中的一個切入點，希望通過本文能夠引起大家對單位犯罪有關(guān)問題研究的興趣，共同為我國刑法體系的完善出謀劃策！
[Abstract]:The unit is a special subject of criminal crime. China's criminal law stipulates that the combination of "single penalty system" and "double penalty system" should be applied to unit crime. Regardless of the principles adopted, the responsible persons in the unit should be held criminally responsible for their criminal acts. In view of the important role of the responsible personnel in the unit crime, this paper intends to discuss the related problems of the responsible personnel in the unit crime from five aspects. First of all, this paper expounds the two theories of criminal liability in criminal law circles and the views of all parties, in order to identify the theoretical basis of criminal punishment of responsible persons in Criminal Law. Then, the common characteristics of the two types of responsible personnel and their different standards of identification are analyzed. Then, in order to better define the two kinds of subjects, the article also makes a brief comparison of the differences between the two, and analyzes the relationship between the two in combination with the case, and also compares the responsible person and the natural person. The different principles of punishment between the responsible persons in the discretion of punishment. Finally, the article discusses some difficult problems of criminal law related to the responsible personnel. Unit crime is a hot issue in the study of criminal law, and the research on the related issues of responsible persons is only one of the entry points. I hope that this paper can arouse the interest of all of us in the study of related issues of unit crime. Make suggestions for the perfection of the criminal law system of our country together!
