【摘要】：170多年的中國法律近現(xiàn)代化,主要是一個"師法泰西"或"以俄為師"的過程。中國現(xiàn)行法律體系,由于偏重"采各國一般慣例"或"與國際接軌",對法制的民族文化、民族精神根基不甚注意,而與民族大眾之間仍存在相當?shù)男睦硎桦x。這種移植法制必須進行本土化或民族化改良,如此才能植根于民族大眾的心田,才能成為社會生活的實際法制。為推動這一改良,建設"中華民族優(yōu)秀法律文化的傳承體系",范忠信教授倡啟"法制(治)中國化"學術工程,并約請周東平教授、陳會林副教授、范依疇博士分別從涉公誹謗罪濫用、官民互動解紛機制建構、親屬參與冤獄防阻機制等細小而具體的問題出發(fā),闡發(fā)中國傳統(tǒng)法律文化的具體智慧和經(jīng)驗,并就未來中國相關法制改良提出具體操作方案。這樣一種基于"歷史法學"方法,以當代中國現(xiàn)實法制緊迫弊端的矯正方案為宗旨的研究,是一種寶貴的嘗試。本期特刊發(fā)這組筆談,以期引起學界的關注和探討。
[Abstract]:The modernization of Chinese law for more than 170 years is mainly a process of "Tessi" or "taking Russia as teacher". In China's current legal system, due to the emphasis on "adopting general customs of other countries" or "connecting with international standards", the national spirit of the national culture of the legal system has not been paid much attention to, but there is still a considerable psychological alienation between the Chinese legal system and the national masses. Only by means of localization or nationalization can the transplant law be rooted in the hearts of the national masses and become the practical legal system in social life. In order to promote this improvement and build the "inheritance system of the excellent legal culture of the Chinese nation," Professor Fan Zhongxin advocated the academic project of "the rule of law (governance) Sinicization", and invited Professor Zhou Dongping and Associate Professor Chen Huilin. Dr. Fan Yichou expounds the specific wisdom and experience of Chinese traditional legal culture from the small and specific problems such as abuse of public defamation, the construction of government-citizen interactive dispute resolution mechanism, and the participation of relatives in the mechanism of prevention of grievance from prison, and so on. And put forward the concrete operation plan for the future Chinese related legal system improvement. It is a valuable attempt to make such a research based on the method of "historical law" and the aim of correcting the urgent malpractice of contemporary Chinese legal system. This issue of the special issue of this group of pen, with a view to arouse academic attention and discussion.
