【摘要】：不純正不作為在一定程度上突破了犯罪的范圍,拓展了犯罪圈,使得對(duì)相關(guān)危害行為的定性更為合理。在區(qū)分作為和不純正不作為的時(shí)候,必須將行為的個(gè)數(shù)予以明確,不能將幾個(gè)行為作為一個(gè)行為來(lái)判斷和評(píng)價(jià);必須明確行為不同的社會(huì)意義,并以此來(lái)區(qū)分作為和不純正不作為;要區(qū)分作為和不純正不作為行為必須找到需要法律評(píng)價(jià)的部分,而不能將法律并不予評(píng)價(jià)的內(nèi)容也納入?yún)^(qū)分的范圍;區(qū)分作為和不純正不作為要圍繞法益的保護(hù)進(jìn)行。
