【摘要】：P2P網(wǎng)貸是互聯(lián)網(wǎng)金融的典型代表。當今"互聯(lián)網(wǎng)+"已成為大眾創(chuàng)業(yè)、萬眾創(chuàng)新的重要媒介,P2P網(wǎng)貸在繁榮民間金融市場、促進金融民主、發(fā)展普惠金融、鼓勵金融創(chuàng)新等方面具有重要意義。但我國P2P網(wǎng)貸平臺存在普遍異化經(jīng)營的現(xiàn)象,嚴重偏離"信息中介"的法律性質(zhì)。其原因主要是法律監(jiān)管主體及其職責不明確,市場準入與退出法律制度不完善,信息披露與保護法律制度不健全,缺乏資金安全性標準,行業(yè)自律監(jiān)管不足。因此應明確P2P網(wǎng)貸平臺作為信息服務(wù)中介的定位,將銀監(jiān)會和地方金融監(jiān)管部門共同作為其監(jiān)管部門,完善P2P網(wǎng)貸平臺的市場準入備案和破產(chǎn)清算管理制度,建立資金第三方存管制度,并要構(gòu)建以政府監(jiān)管和行業(yè)協(xié)會自律監(jiān)管相結(jié)合的混合模式,完善P2P網(wǎng)貸平臺"異化"經(jīng)營的法律規(guī)制內(nèi)容。
[Abstract]:P2P network loan is a typical representative of internet finance. Nowadays, "Internet" has become an important medium for mass entrepreneurship and innovation. P2P network lending is of great significance in prospering the private financial market, promoting financial democracy, developing inclusive finance and encouraging financial innovation. However, the phenomenon of universal alienation of P2P network loan platform deviates from the legal nature of "information intermediary". The main reasons are that the subject of legal supervision and its responsibilities are not clear, the legal system of market access and withdrawal is not perfect, the legal system of information disclosure and protection is not perfect, the safety standard of funds is lacking, and the self-regulation of industry is insufficient. Therefore, it is necessary to define the position of P2P network loan platform as an information service intermediary, take CBRC and local financial supervision department as its regulators, and perfect the market access filing and bankruptcy liquidation management system of P2P network loan platform. In order to set up the third party fund management system and build the mixed mode of government supervision and trade association self-regulation, we should perfect the legal regulation content of P2P network loan platform's "alienation" operation.
