【摘要】："造成惡劣社會影響"是司法解釋為瀆職罪設(shè)置的追訴標(biāo)準(zhǔn)之一,但由于其概念相對抽象,以及司法人員對其理解上的偏差,適用中出現(xiàn)了自由裁量較為隨意、適用范圍泛化、輕刑化嚴(yán)重等問題,影響了司法的權(quán)威和公正。應(yīng)從糾正理解和認(rèn)識偏差入手,理清其與非物質(zhì)損失之間的關(guān)系,準(zhǔn)確把握"惡劣社會影響"的涵義,綜合判斷、完善方法、謹(jǐn)慎適用;總結(jié)既判案件中"造成惡劣社會影響"具體表現(xiàn)形式,提煉升華、細(xì)化瀆職罪相關(guān)司法解釋;運(yùn)用好案例指導(dǎo)制度,編撰參考案例,以保證法律的正確實施和司法公正。
[Abstract]:"causing bad social impact" is one of the standards for prosecution of malfeasance. However, due to its relatively abstract concept and the deviation of judicial officers' understanding of it, there is free discretion and extensive scope of application. Light punishment and other serious problems affect the authority and justice of the judiciary. We should start with correcting understanding and understanding deviation, clarify the relationship between it and non-material loss, accurately grasp the meaning of "bad social influence", comprehensively judge, perfect the method, and apply it prudently. This paper summarizes the concrete forms of "causing bad social impact" in the res judicata cases, refines the judicial interpretation of the crime of dereliction of duty, makes use of the case guidance system and compiles reference cases to ensure the correct implementation of the law and judicial justice.
