【摘要】：近年來(lái),互聯(lián)網(wǎng)的迅速發(fā)展使人們享受著各種方便和快捷,然而事物都有兩面性,毒品犯罪分子將其犯罪領(lǐng)域拓展到互聯(lián)網(wǎng)則會(huì)給全社會(huì)帶來(lái)巨大的破壞。2011年10月,公安部指揮全國(guó)公安機(jī)關(guān)開(kāi)展統(tǒng)一行動(dòng)成功偵破“8·31特大網(wǎng)絡(luò)吸販毒案”,這是我國(guó)網(wǎng)絡(luò)涉毒犯罪首例案件,在感嘆其跨地域大、涉案人員多、繳獲毒品數(shù)量大的同時(shí)也讓利用網(wǎng)絡(luò)進(jìn)行涉毒行為得到專(zhuān)家學(xué)者們的重視,故整治互聯(lián)網(wǎng)涉毒犯罪十分迫切。本文主要通過(guò)四個(gè)部分進(jìn)行討論:第一部分交代網(wǎng)絡(luò)涉毒犯罪的發(fā)展背景、現(xiàn)狀和趨勢(shì)。毒品犯罪與其他傳統(tǒng)犯罪一樣,隨著科技的進(jìn)步而與網(wǎng)絡(luò)不斷交融聯(lián)系,在網(wǎng)絡(luò)的重新包裝下傳統(tǒng)毒品犯罪也出現(xiàn)了新的形式,傳統(tǒng)毒品犯罪的諸多壁壘在網(wǎng)絡(luò)技術(shù)的發(fā)展下不斷被打破,網(wǎng)絡(luò)平臺(tái)如果被不法分子別有用心的利用就會(huì)演變成一個(gè)學(xué)習(xí)交流犯罪方法、傳播犯罪成果的惡性平臺(tái)。第二部分介紹網(wǎng)絡(luò)涉毒犯罪的行為方式及特點(diǎn)。虛擬空間中開(kāi)設(shè)私人聊天室被犯罪分子濫用,引發(fā)了在虛擬空間中進(jìn)行吸毒交流、集體吸毒、引誘他人吸毒、趁機(jī)兜售毒品、傳授制毒方法等一系列極其惡劣的行為,犯罪分子利用互聯(lián)網(wǎng)跨地域性、智能化、低成本、低風(fēng)險(xiǎn)等特點(diǎn)肆意散播毒品信息,其行為破壞了建立綠色、純凈網(wǎng)絡(luò)空間的初衷,敗壞了社會(huì)的正常價(jià)值觀,毒害了大量青少年的身心健康。第三部分討論我國(guó)當(dāng)前網(wǎng)絡(luò)涉毒犯罪的爭(zhēng)議問(wèn)題。網(wǎng)絡(luò)涉毒犯罪中利用網(wǎng)絡(luò)組織多人進(jìn)行在線吸毒表演行為的認(rèn)定就是一個(gè)分歧較多的問(wèn)題,該問(wèn)題的主要觀點(diǎn)有:容留擴(kuò)展說(shuō)、二分說(shuō)、無(wú)罪說(shuō)和《刑法修正案(九)》及相關(guān)司法解釋的規(guī)定;信息網(wǎng)絡(luò)服務(wù)者提供技術(shù)支持的幫助行為是否構(gòu)罪存在著幫助犯和獨(dú)立構(gòu)罪的爭(zhēng)議;互聯(lián)網(wǎng)+時(shí)代物流寄遞行業(yè)作為網(wǎng)絡(luò)涉毒犯罪線下交易的關(guān)鍵部分其作用越發(fā)重要,對(duì)其行為及現(xiàn)狀的研究有利于打擊網(wǎng)絡(luò)涉毒犯罪行為。第四部分主要從物流渠道的規(guī)范化、網(wǎng)絡(luò)涉毒犯罪立法方面和網(wǎng)絡(luò)涉毒犯罪的刑法理念三個(gè)部分討論如何針對(duì)當(dāng)前網(wǎng)絡(luò)涉毒犯罪中的問(wèn)題進(jìn)行刑法的規(guī)制。
[Abstract]:In recent years, the rapid development of the Internet makes people enjoy all kinds of convenience and rapidity. However, there are two sides to everything. Drug criminals will bring great damage to the whole society by extending their criminal field to the Internet. The Ministry of Public Security directed the national public security organs to carry out a unified operation to successfully crack down on the "831 extraordinarily large network drug sucking and drug trafficking case." this is the first case of a drug-related cyber crime in China. At the same time, experts and scholars pay more attention to drug-related behavior through internet, so it is urgent to clean up drug-related crimes on the internet. This paper mainly discusses through four parts: the first part describes the development background, current situation and trend of network drug-related crime. Drug crimes, like other traditional crimes, are constantly intertwined with the network with the progress of science and technology. Under the re-packaging of the network, traditional drug crimes have also taken on new forms. With the development of network technology, many barriers of traditional drug crime are constantly broken. If the network platform is used by criminals with ulterior motives, it will evolve into a vicious platform for learning and exchanging criminal methods and spreading criminal achievements. The second part introduces the behavior and characteristics of network drug-related crime. The opening of private chat rooms in the virtual space was abused by criminals, which led to a series of extremely abominable behaviors such as drug abuse communication in the virtual space, group drug use, inducement of others to take drugs, peddling drugs and imparting methods of making drugs. Criminals wantonly spread drug information by taking advantage of the characteristics of the Internet, such as trans-regional, intelligent, low-cost, low-risk, and so on. Their behavior undermines the original intention of establishing green and pure cyberspace and undermines the normal values of society. Poisons the physical and mental health of a large number of teenagers. The third part discusses the current network drug-related crimes in China. In the network drug-related crime, the identification of using the network to organize many people to perform online drug abuse is a problem with many differences. The main points of view of this problem are as follows: tolerance extension theory, dichotomy theory, The theory of innocence and the provisions of the Criminal Law Amendment (9) and the relevant judicial interpretation; Whether the aiding behavior provided by the information network service provider has the dispute of aiding crime and independent construction crime; In the Internet era, as a key part of the network drug-related crime line transactions, the logistics and delivery industry plays an increasingly important role, and the research on its behavior and current situation is conducive to crack down on the network drug-related crimes. The fourth part mainly discusses how to regulate the current network drug-related crime from three parts: the standardization of logistics channels, the legislation of network drug-related crime and the criminal law concept of network drug-related crime.
