【摘要】：在矛盾沖突日趨多樣化的現代法治社會，私力救濟在糾紛解決中依舊扮演著重要角色，補充著公力救濟的不足。私力救濟與公力救濟一樣都需要法律來加以規(guī)范。 本文全文大約三萬字左右，總共分為四章，從范圍和限度出發(fā)，對私力救濟進行了深入的研究，提出了一些規(guī)范私力救濟行為的建議。 第一章，以一系列非法維權案例引出私力救濟的話題，指出私力救濟是需要加以規(guī)范的救濟方式。然后從私力救濟的概念及特征入手，論及私力救濟的價值及缺陷，指出以法律來規(guī)范私力救濟的必要性。 第二章，從不同的角度出發(fā)研究私力救濟的范圍。首先，從歷史發(fā)展的角度，考察不同時期對私力救濟的態(tài)度，然后從橫向的各國法律出發(fā)來論述各國對于私力救濟范圍的規(guī)定。研究我國法律中私力救濟的范圍時，以部門法為視角，，在整個法律體系內進行，而不是僅僅局限于民商法領域。這樣以比較研究的方法，全面呈現出，與域外法律相比之下，我國法律對私力救濟范圍的過度限制。 第三章，繼續(xù)以比較研究的方法，并且結合了相關判例，介紹了大陸法系和英美法系國家關于私力救濟限度的不同規(guī)定，以及各自的判斷標準，與我國法律的相關規(guī)定進行對比，指出我國關于私力救濟限度的法律規(guī)定存在不完善之處，即對限度的規(guī)定十分模糊，不易判斷。 第四章，在前面幾章的論述后，借鑒各國對私力救濟范圍及限度的規(guī)定，以及相關案例，提出構建私力救濟法律控制體系的構想，圍繞私力救濟的范圍及限度相關規(guī)定的完善，以及對幾種典型的私力救濟行為的具體規(guī)范，建立一個完整的私力救濟制度，從而構建出包含私力救濟、公力救濟以及社會救濟的多元化糾紛解決機制。
[Abstract]:In the modern legal society where contradictions and conflicts are becoming more and more diverse, private relief still plays an important role in dispute resolution and complements the deficiency of public remedy. Private relief, like public relief, needs to be regulated by law. This paper consists of about 30,000 words, which is divided into four chapters. Based on the scope and limitation, this paper makes a deep study on the private relief, and puts forward some suggestions for regulating the private relief behavior. In the first chapter, a series of cases of illegal rights protection lead to the topic of private relief, pointing out that private relief is a remedy that needs to be standardized. Then from the concept and characteristics of private relief, the paper discusses the value and defects of private relief, and points out the necessity of regulating private relief by law. The second chapter studies the scope of private relief from different angles. First of all, from the perspective of historical development, this paper examines the attitude towards private relief in different periods, and then discusses the scope of private relief in different countries from the perspective of horizontal national laws. When studying the scope of private relief in Chinese law, it is carried out in the whole legal system from the angle of department law, not confined to the field of civil and commercial law. In this way, compared with the foreign laws, the scope of private relief is restricted by the law of our country. The third chapter, with the method of comparative study, and combined with the relevant jurisprudence, introduces the different provisions of the private relief limits and their respective judgment standards in the countries of civil law system and common law system. Comparing with the relevant provisions of Chinese law, the author points out that there are some imperfections in the legal provisions on the limits of private relief in our country, that is, the provisions of the limits are very vague and difficult to judge. The fourth chapter, after the discussion in the preceding chapters, draws lessons from the various countries to the private relief scope and the limit stipulation, as well as the correlation case, proposed the construction private power relief legal control system idea, revolves the private power relief scope and the limit correlation stipulation consummation, And to several typical private relief behavior concrete standard, establishes a complete private power relief system, thus constructs the diversification dispute settlement mechanism which includes the private power relief, the public power relief and the social relief.
