【摘要】：具有"去中心化"性質的互聯(lián)網(wǎng)金融平臺是互聯(lián)網(wǎng)思維在金融領域內的創(chuàng)新性產(chǎn)物。國內互聯(lián)網(wǎng)金融平臺主要衍化為純平臺模式、擔保模式、債權轉讓模式三大類,可能存在"偽"平臺風險、模式風險、中立幫助行為風險等。防范互聯(lián)網(wǎng)金融平臺的刑事風險是規(guī)范該行業(yè)健康發(fā)展的底線。對于以互聯(lián)網(wǎng)金融之名行資金自融之實的"偽"平臺,應依據(jù)資金用途限制非法吸收公眾存款罪的適用;對于違規(guī)提供擔保的平臺,應給予行政處罰并令其承擔連帶保證責任;對于違規(guī)設立資金池的平臺,應視具體情形作出不同處理;對于提供中立幫助行為的平臺,應分別從"投資端"、"融資端"視角,對幫助信息網(wǎng)絡犯罪構成要件中的"明知"作不同的理解和認定。
[Abstract]:The internet financial platform with the nature of "decentralization" is the innovative product of Internet thinking in the field of finance. Domestic Internet financial platforms are mainly derived from pure platform mode, guarantee mode and creditor's rights transfer mode. There may be "false" platform risk, mode risk, neutral help behavior risk and so on. Preventing the criminal risk of Internet financial platform is the bottom line of standardizing the healthy development of this industry. For the real "false" platform in the name of Internet finance, the application of the crime of illegally absorbing public deposits should be restricted according to the use of funds, and the platform for providing security illegally should be subject to administrative punishment and joint and several guaranty liability. For the illegal establishment of funds pool platform, according to the specific situation should be dealt with differently; To provide the platform of neutral helping behavior, we should make different understanding and cognizance of "knowing" in the constituent elements of helping information network crime from the angle of "investment end" and "financing end" respectively.
