【摘要】：網(wǎng)絡(luò)空間中的信息流動(dòng)導(dǎo)致信息權(quán)成為刑法需要予以保護(hù)的法益類型,基于對侵害信息權(quán)犯罪風(fēng)險(xiǎn)的前置防控需求和缺乏健全法律治理體系的現(xiàn)狀,網(wǎng)絡(luò)中介服務(wù)者及其刑事責(zé)任在我國當(dāng)前對侵害信息權(quán)犯罪的法律治理中具備了中心價(jià)值�！缎谭ㄐ拚�(九)》新增的第286條之一拒不履行網(wǎng)絡(luò)安全管理義務(wù)罪,即為網(wǎng)絡(luò)中介服務(wù)者設(shè)定了不純正不作為的刑事責(zé)任,作為預(yù)防性刑事立法,應(yīng)當(dāng)對其進(jìn)行嚴(yán)格的限縮解釋。即在法益保護(hù)目的的限定下,根據(jù)網(wǎng)絡(luò)中介服務(wù)者不同的主體類型,厘清"信息網(wǎng)絡(luò)安全管理義務(wù)"的內(nèi)涵,進(jìn)而依照不純正不作為犯的歸責(zé)進(jìn)路,即以條件說、對原因的支配關(guān)系、一次規(guī)范中附有法律責(zé)任的作為義務(wù)順序,立體地進(jìn)行不純正不作為幫助犯的刑事歸責(zé)判定。
[Abstract]:The flow of information in cyberspace leads to the right of information to be protected as the legal interest type of criminal law, based on the need for prevention and control of the risk of infringing on the crime of information rights and the lack of a sound legal governance system. The network intermediary service provider and its criminal responsibility have the central value in the current legal administration of the crime of infringing upon the right to information in our country. One of the new article 286 of the Criminal Law Amendment (9) > refuses to fulfill the obligation of network security management. That is to say, the network intermediary should be strictly limited and interpreted as a preventive criminal legislation. That is, under the limitation of the purpose of legal interest protection, according to the different types of subjects of network intermediary service, the connotation of "information network security management obligation" is clarified, and then according to the imputative path of imputable omission, that is to say, the theory of conditions. In the dominant relation of cause, there is the order of duty of legal responsibility in a norm, and the criminal imputation of imputable omission is determined stereoscopically.
