【摘要】：非食品原料制售行為的規(guī)制是刑法遏制食品犯罪源頭的關(guān)鍵,其定罪問題在實(shí)務(wù)與理論中存在爭議。"以危險(xiǎn)方法危害公共安全罪"與"非法經(jīng)營罪"的適用分別存在行為與客體的瑕疵,"生產(chǎn)、銷售有毒、有害食品罪"的選用具有合理性,但現(xiàn)有理論對(duì)適用根據(jù)的解讀存在局限。持"生產(chǎn)、銷售有毒、有害食品罪"之幫助犯的定罪觀點(diǎn),理論路徑是延展幫助犯理論,將其定位于解決社會(huì)中"幫助"危害社會(huì)現(xiàn)象的刑法理論;定型于幫助行為、幫助故意和幫助情節(jié)組成的定罪標(biāo)準(zhǔn)系統(tǒng);定制于有權(quán)解釋機(jī)關(guān)做出的司法解釋。
[Abstract]:The regulation of non-food raw material production and sale is the key of the criminal law to curb the food crime source, and its conviction is controversial in practice and theory. " The application of the crime of endangering public safety by dangerous method "and the crime of illegal operation" have the defects of behavior and object respectively, and the choice of the crime of "producing and selling poisonous and harmful food" is reasonable. However, there are limitations in the interpretation of the applicable basis in existing theories. The author holds the conviction view of "the crime of producing, selling poisonous and harmful food", and the theoretical path is to extend the theory of aiding crime and position it as the criminal law theory to solve the problem of "help" endangering the society in the society. A standard system of convictions based on aiding behavior, aiding intent, and aiding circumstances; customised to a judicial interpretation given by an agency with the power to interpret.
