【摘要】：隨著網(wǎng)絡(luò)時代的到來,侮辱網(wǎng)絡(luò)虛擬身份的案件層出不窮。網(wǎng)絡(luò)虛擬身份是在網(wǎng)絡(luò)虛擬世界進行網(wǎng)絡(luò)生存、開展互動與社交的關(guān)系定位,具有匿名性、現(xiàn)實性與多元性等特征。網(wǎng)絡(luò)虛擬身份雖然沒有獨立人格,卻能夠映射、關(guān)聯(lián)現(xiàn)實主體的人格,是使用者自身的"電子延伸",值得法律予以保護。侮辱網(wǎng)絡(luò)虛擬身份的行為必須具有公然性,且他人能夠根據(jù)虛擬身份推斷出被害人的現(xiàn)實身份,并可能降低其外部名譽或貶損內(nèi)部名譽時,方可成立侮辱罪。
[Abstract]:With the arrival of the network age, the cases of insulting the virtual identity of the network emerge in endlessly. The virtual identity of the network is to carry on the network existence in the network virtual world, carry out the relation localization of the interaction and the social intercourse, have the characteristics of anonymity, reality and diversity. Although the network virtual identity has no independent personality, it can be mapped. The personality of the related reality subject is the "electronic extension" of the user itself and deserves the protection of the law. Only when the act of insulting the virtual identity of the network is public, and others can deduce the real identity of the victim according to the virtual identity, and may degrade their external reputation or degrade the internal reputation, can the crime of insult be established.
