【摘要】：當(dāng)今,醉酒駕駛機(jī)動(dòng)車輛而導(dǎo)致的重大交通事故頻發(fā),為了強(qiáng)化對(duì)公眾安全的保障,世界各國(guó)都強(qiáng)化了刑法對(duì)醉駕行為的規(guī)制。大陸地區(qū)和臺(tái)灣地區(qū)都將醉駕入刑,并在司法實(shí)踐中產(chǎn)生了大量的司法判例,通過(guò)對(duì)比分析這些判例可以發(fā)現(xiàn)兩岸對(duì)醉駕行為的定罪量刑存在著諸多差異。由于臺(tái)灣地區(qū)醉駕的立法時(shí)間較早,司法運(yùn)作的經(jīng)驗(yàn)較為成熟,其相關(guān)做法可以成為大陸地區(qū)完善相關(guān)司法活動(dòng)的借鑒素材,通過(guò)這種經(jīng)驗(yàn)的學(xué)習(xí)和借鑒應(yīng)能推動(dòng)大陸地區(qū)有關(guān)醉駕行為定罪量刑的發(fā)展和完善。
[Abstract]:Nowadays, the major traffic accidents caused by drunk driving motor vehicles occur frequently. In order to strengthen the protection of public safety, countries in the world have strengthened the criminal law to regulate drunk driving behavior. Both the mainland and Taiwan will drive drunk into punishment, and in judicial practice has produced a large number of judicial precedents, through comparative analysis of these precedents, we can find that there are many differences in the conviction and sentencing of drunk driving between the two sides of the strait. As the legislation of drunk driving in Taiwan is earlier and the experience of judicial operation is relatively mature, the relevant practices can be used as reference materials for the mainland to perfect the relevant judicial activities. The study and reference of this kind of experience should promote the development and perfection of the conviction and sentencing of drunken driving in mainland China.
