【摘要】：近年來我國制毒物品犯罪問題沒有得到根本遏制,呈現(xiàn)愈演愈烈態(tài)勢。2015年頒布實(shí)施的《中華人民共和國刑法修正案(九)》為執(zhí)法機(jī)關(guān)全鏈條打擊生產(chǎn)、買賣、運(yùn)輸和走私制毒物品犯罪提供了更為完善的法律依據(jù),但在實(shí)踐中仍存在全流程監(jiān)管難、情報(bào)線索獲取難、證據(jù)搜集固定難等諸多問題。立足當(dāng)前制毒物品犯罪的現(xiàn)狀與偵防難點(diǎn),借助數(shù)據(jù)分析相關(guān)原理及手段,從全程監(jiān)測預(yù)警、研發(fā)數(shù)據(jù)分析模型、強(qiáng)化電子取證技術(shù)等方面提出偵防對策,以期精確指導(dǎo)制毒物品犯罪偵防工作,有效遏制制毒犯罪活動的蔓延態(tài)勢。
[Abstract]:In recent years, the criminal problem of drug manufacturing in China has not been fundamentally curbed, showing a growing trend. The Criminal Law Amendment of the people's Republic of China (9) promulgated and implemented in 2015 is a full-chain crackdown on production and sale by law enforcement agencies. The crime of transporting and smuggling drug goods provides a more perfect legal basis, but there are still many problems in practice, such as the difficulty of supervision of the whole process, the difficulty of obtaining intelligence clues, the difficulty of collecting and fixing evidence, and so on. Based on the current situation and difficulties of drug manufacturing crime, with the help of relevant principles and means of data analysis, the paper puts forward some countermeasures from the following aspects: whole process monitoring and warning, research and development of data analysis model, strengthening of electronic forensics technology, etc. In order to accurately guide the crime detection and prevention of drug production, effectively curb the spread of drug manufacturing criminal activities.
