【摘要】：近幾年,由于社會(huì)上一些不法分子組織和操縱未成年人從事違法犯罪活動(dòng)屢禁不止,而且還日益猖獗,這些行為一方面嚴(yán)重?cái)_亂了社會(huì)治安管理秩序,另一方面還妨害了未成年人身心健康的發(fā)展與成長,社會(huì)危害性極其嚴(yán)重,是當(dāng)前危害我國社會(huì)治安的主要因素。面對未成年人違法犯罪的急劇增加,各國都注意集中法學(xué)家、犯罪學(xué)家和社會(huì)學(xué)家以及其他社會(huì)各界力量,紛紛捕捉未成年人違法犯罪的原因以及尋求制止和打擊預(yù)防對策。為扭轉(zhuǎn)實(shí)務(wù)部門在打擊組織未成年人進(jìn)行違反治安管理活動(dòng)行為的被動(dòng)格局,保護(hù)未成年人的合法權(quán)利,我國通過修改立法在《刑法修正案(七)》中將組織未成年人進(jìn)行盜竊、詐騙、搶奪、敲詐勒索等違反治安管理活動(dòng)的行為規(guī)定為犯罪。這樣的規(guī)定,首先是有利于保障未成年人的身心健康,其次是對維護(hù)良好的社會(huì)治安管理秩序起到促進(jìn)作用,同時(shí)也對嚴(yán)厲懲治和防范組織未成年人進(jìn)行違反治安管理活動(dòng)的行為起到刑法威懾作用。 本文共分為四部分進(jìn)行研究,第一部分是對本罪的概述,第二部分是對本罪構(gòu)成特征的分析,第三部分是對本罪司法認(rèn)定中存在的問題進(jìn)行研究,第四部分是根據(jù)分析和研究提出筆者認(rèn)為合理的完善建議。
[Abstract]:In recent years, as some lawless elements in society have organized and manipulated minors to engage in illegal and criminal activities, and have become increasingly rampant, on the one hand, these acts have seriously disturbed the order of public security management. On the other hand, it also hinders the development and growth of minors' physical and mental health. In the face of the sharp increase of juvenile delinquency, all countries pay attention to the concentration of jurists, criminologists and sociologists, as well as other social forces, to capture the causes of juvenile delinquency and to seek preventive measures to stop and combat juvenile delinquency. In order to reverse the passive pattern of the practical departments in cracking down on the activities of organizing minors to carry out activities in violation of public security management, and to protect the lawful rights of minors, In the Amendment of Criminal Law (7), our country makes it a crime to organize minors to commit theft, fraud, snatch, extortion and other violations of public security management. Such provisions are, first, conducive to safeguarding the physical and mental health of minors, and secondly, promoting the maintenance of good public order and order. At the same time, it also acts as a criminal law deterrent to severely punish and prevent minors from violating public security management activities. This paper is divided into four parts, the first part is an overview of the crime, the second part is the analysis of the characteristics of the crime, the third part is to study the problems existing in the judicial determination of this crime. The fourth part is based on the analysis and research to put forward reasonable suggestions for improvement.
