【摘要】："謀取不正當(dāng)利益"是行賄罪解釋論的核心問題。為了實(shí)現(xiàn)行賄罪的法益保護(hù)目的,保證行賄罪構(gòu)成要件結(jié)構(gòu)的完整性,應(yīng)當(dāng)將解釋方向由行為人一端轉(zhuǎn)換到國家工作人員一端,將國家工作人員是否違背職務(wù)作為判斷行為人所謀取的利益是否正當(dāng)?shù)臉?biāo)準(zhǔn)。由此,在立法文字上缺失的"違背職務(wù)與給予財(cái)物之間的對價(jià)關(guān)系",就在解釋論上被建構(gòu)起來,被補(bǔ)充進(jìn)行賄罪的構(gòu)成要件。國家工作人員違背職務(wù),包括違反規(guī)則與違背原則兩種形式。在適用2012年"兩高"《關(guān)于辦理行賄刑事案件具體應(yīng)用法律若干問題的解釋》第12條第1款時(shí),可以拋棄前段中關(guān)于實(shí)體違法利益的無益規(guī)定;在適用該條第2款時(shí),應(yīng)當(dāng)注意規(guī)范對象已由行為人回歸到國家工作人員,注意"酌情決定"與任意處置性職務(wù)行為的區(qū)分,注意違背公平、公正原則與"競爭優(yōu)勢"之間的關(guān)系。
[Abstract]:Seeking improper interests "is the core issue of the explanation theory of bribery crime." In order to achieve the purpose of legal interest protection of bribery crime and to ensure the integrity of the structure of the constitutive elements of bribery crime, the direction of interpretation should be transferred from one end of the perpetrator to one end of the state functionary. Whether the state functionaries violate their duties is regarded as the criterion to judge whether the interests obtained by the doers are justified. Therefore, the absence of the relationship between the breach of duty and the giving of property in the legislative writing has been constructed in the interpretation theory and added to the constitutive elements of the crime of bribery. State functionaries violate their duties, including violation of rules and principles. In the application of article 12, paragraph 1, of the 2012 "two High" interpretation on the specific application of the law in criminal cases of bribery ", the unhelpful provisions of the preceding paragraph on the illegal interests of entities may be abandoned; In applying paragraph 2 of that article, attention should be paid to the return of the object of the norm from the perpetrator to a State official, to the distinction between "as appropriate" and to acts of arbitrary disposition, and to the violation of fairness, The relationship between the principle of justice and competitive advantage.
