論刑法刑事政策化

【摘要】：刑法刑事政策化,意在強(qiáng)調(diào)刑事政策對(duì)刑法體系的作用力以及刑法體系對(duì)刑事政策的反作用力。與其認(rèn)為刑事政策化是一種理論言說,毋寧說,刑法刑事政策化是實(shí)然層面各國(guó)正在共同經(jīng)歷的一個(gè)過程。 該命題的核心在于正確處理好刑事政策與刑法體系的關(guān)系。德國(guó)刑法學(xué)發(fā)展史為我們提供了兩種方式選擇：李斯特分離式與羅克辛合一式,并且以實(shí)踐經(jīng)驗(yàn)向我們展示了合一式的巨大潛能。在全球化背景下,人們生活方式高度趨同,現(xiàn)代社會(huì)矛盾在不同國(guó)家高度相似。尚處于前法治時(shí)代的中國(guó)沒有機(jī)會(huì)再倒回李斯特的時(shí)代原點(diǎn)進(jìn)行一場(chǎng)漫長(zhǎng)演進(jìn),只能立足當(dāng)下,吸收德國(guó)刑法學(xué)發(fā)展成果進(jìn)行一場(chǎng)百年跨越。正確認(rèn)識(shí)分析目的理性刑法體系,結(jié)合本土資源進(jìn)行中國(guó)化改造,尋求適合中國(guó)刑法刑事政策化的道路,正是本文意旨所在。
[Abstract]:The criminal policy of criminal law is intended to emphasize the influence of criminal policy on criminal law system and the reaction force of criminal law system to criminal policy. Instead of thinking that the criminal policy is a theoretical statement, it is rather that the criminal policy of criminal law is a process that all countries are going through. The core of this proposition lies in correctly handling the relation between criminal policy and criminal law system. The history of criminal law in Germany provides us with two ways to choose: Liszt split and Roxin, and shows us the great potential of Oneness with practical experience. Under the background of globalization, people's lifestyles are highly convergent, and modern social contradictions are highly similar in different countries. China, which is still in the pre-rule of law era, has no chance to go back to Liszt's origin for a long evolution, only to base itself on the present and absorb the achievements of German criminal law development for a hundred years. It is the purpose of this article to correctly understand and analyze the system of rational criminal law, combine with local resources to reform the criminal policy of Chinese criminal law and find a way suitable for the criminal policy of Chinese criminal law.
