【摘要】：這篇文章著重對(duì)入戶盜竊、扒竊、攜帶兇器盜竊和多次盜竊這四種特殊盜竊行為的司法認(rèn)定過(guò)程中的問(wèn)題進(jìn)行研究。第一章介紹了四種特殊盜竊行為的概念。以及1979年以來(lái)特殊盜竊行為的相關(guān)立法變遷。對(duì)德國(guó)、日本、意大利、匈牙利、美國(guó)、英國(guó)的特殊盜竊的立法情形作了介紹。第二章介紹了入戶盜竊的認(rèn)定研究。首先“戶”具有場(chǎng)所和功能兩大特征�！皯簟背司哂兴矫苄院团潘缘耐瑫r(shí),還應(yīng)有家庭生活功能。集體宿舍、無(wú)人居住的住宅、酒店賓館和臨時(shí)搭建的工棚一般不能認(rèn)定為“戶”,但是封閉性較好,具有家庭生活功能的宅院和在非營(yíng)業(yè)時(shí)間的商住一體房,以及臨時(shí)居住的別墅應(yīng)當(dāng)認(rèn)定為“戶”。其次,入戶盜竊的“入”應(yīng)當(dāng)是具有非法性。最后入戶盜竊的既遂標(biāo)準(zhǔn)采取的是“失控說(shuō)加控制說(shuō)”。第三章介紹了扒竊的認(rèn)定研究。首先,文中支持扒竊的實(shí)施場(chǎng)所是公共場(chǎng)所,具有的特征是:開(kāi)放性,時(shí)間性和人數(shù)不特定性。其次,對(duì)犯罪對(duì)象進(jìn)行了解析,文中支持隨身攜帶的財(cái)物的隨身性是“隨時(shí)支配范圍說(shuō)”。最后,扒竊既遂標(biāo)準(zhǔn)是“失控說(shuō)加控制說(shuō)”。第四章介紹了攜帶兇器盜竊的認(rèn)定研究。首先,從兇器的危險(xiǎn)性和行為人的主觀意志來(lái)判定是否為兇器,如少數(shù)民族人按照習(xí)俗佩戴刀具,人們隨身攜帶的小物件或作案工具不能被認(rèn)定為兇器。其次,應(yīng)是在盜竊過(guò)程中攜帶兇器。最后,既遂標(biāo)準(zhǔn)采取的是“失控說(shuō)加控制說(shuō)”。第五章介紹了多次盜竊的認(rèn)定研究。首先,“次”的認(rèn)定應(yīng)當(dāng)具有一個(gè)犯罪故意和連續(xù)的時(shí)間段,還應(yīng)當(dāng)結(jié)合當(dāng)時(shí)的地點(diǎn)環(huán)境。已受行政處罰的盜竊行為也應(yīng)被計(jì)入“次”內(nèi)。其次,文中多次盜竊的既遂標(biāo)準(zhǔn)采取的是“失控說(shuō)加控制說(shuō)”。
[Abstract]:This article focuses on the problems in the judicial identification of four special kinds of theft, namely burglary, pickpocketing, burglary with murder weapon and multiple theft. The first chapter introduces the concept of four special acts of theft. And the special theft since 1979 related legislative changes. The special theft legislation in Germany, Japan, Italy, Hungary, the United States and the United Kingdom is introduced. The second chapter introduces the identification of burglary. First of all, the "household" has two major features: place and function. In addition to privacy and exclusivity, households should also have family life functions. Dormitories, uninhabited residences, hotels, hotels and temporary sheds are generally not considered "households," but they are more closed, with the function of family life and commercial and residential housing during non-business hours. And temporary residence villas should be recognized as "households." Secondly, the burglary should be illegal. Finally, the accomplished standard of burglary is "out of control theory plus control theory". The third chapter introduces the identification of pickpocketing. Firstly, the implementation place of pickpocketing is a public place, which is characterized by openness, time and number of people. Secondly, the author analyzes the object of crime. Finally, pickpocketing accomplished standard is "out of control theory plus control." The fourth chapter introduces the identification of the theft with the murder weapon. First of all, judging whether the weapon is a murder weapon from the danger of the weapon and the subjective will of the perpetrator, such as the minority people wear the knife according to the custom, the small object or the crime tool that people carry with them can not be considered as the murder weapon. Second, it should be in the process of theft with the murder weapon. Finally, the standard of accomplishment is "out of control theory plus control theory". The fifth chapter introduces the identification research of multiple theft. First of all, the identification of "secondary" should have a criminal intent and continuous time period, and should be combined with the location of the environment. Theft that has been subject to administrative punishment should also be counted as "secondary". Secondly, the accomplished standard of multiple thefts in this paper is "out of control theory plus control theory".
