【摘要】：藥品作為一種特殊的商品,它的安全與人的生命、健康緊密相關,是社會公眾十分關注的民生問題。本文以近三年B市C區(qū)辦理的危害藥品安全犯罪為樣本,分析了此類案件的特點,探討了假藥、劣藥的認定,生產、銷售假藥罪的入罪標準,以及主觀罪過如何認定等問題。
[Abstract]:As a special commodity, drug safety is closely related to human life and health. Taking the crime of endangering drug safety handled in area C of B city in recent three years as the sample, this paper analyzes the characteristics of this kind of case, probes into the identification of counterfeit medicine, the identification of inferior medicine, the standard of incriminating crime of producing and selling counterfeit drugs, and how to determine the subjective sin, and so on.
