【摘要】：對網(wǎng)絡(luò)詐騙進(jìn)行研究,應(yīng)充分了解網(wǎng)絡(luò)犯罪的基本特征。網(wǎng)絡(luò)犯罪就是信息化的犯罪。網(wǎng)絡(luò)詐騙是通過操作個(gè)人信息實(shí)現(xiàn)詐騙目標(biāo)的行為,從發(fā)展趨勢看,網(wǎng)絡(luò)詐騙對個(gè)人信息的依賴程度會(huì)越來越高。治理網(wǎng)絡(luò)詐騙的關(guān)鍵,在于確保公民個(gè)人信息安全。雖然個(gè)人信息相關(guān)人對這一信息的利益不能看作一種獨(dú)立權(quán)利,但保護(hù)個(gè)人信息對于維護(hù)公民的人身、財(cái)產(chǎn)安全具有重要意義,因而對刑法中的個(gè)人信息應(yīng)從人身和財(cái)產(chǎn)安全的角度加以界定。對于網(wǎng)絡(luò)詐騙的定罪,應(yīng)充分認(rèn)識其特點(diǎn),并與處理線下犯罪有所區(qū)分。預(yù)防網(wǎng)絡(luò)詐騙,應(yīng)實(shí)現(xiàn)多部門配合、公私聯(lián)動(dòng)、跨法域合作的機(jī)制,并將信息管理作為建立合作機(jī)制的重要內(nèi)容。
[Abstract]:To study network fraud, we should fully understand the basic characteristics of network crime. Network crime is an information-based crime. Network fraud is the act of operating personal information to achieve the goal of fraud. From the perspective of development trend, network fraud will become increasingly dependent on personal information. Personal information security. Although the interests of the persons concerned with personal information can not be regarded as an independent right, the protection of personal information is of great significance to the protection of citizens'personal and property security. Therefore, personal information in criminal law should be defined from the perspective of personal and property security. To prevent network fraud, we should realize the mechanism of multi-department cooperation, public-private interaction, cross-jurisdiction cooperation, and take information management as an important part of establishing cooperation mechanism.
