【摘要】：環(huán)境污染目前已經(jīng)成為世界各國(guó)廣泛關(guān)注的問(wèn)題,在認(rèn)真反思環(huán)境污染現(xiàn)狀的基礎(chǔ)上，各國(guó)政府都在尋求解決環(huán)境污染問(wèn)題的有效方式。目前通過(guò)加強(qiáng)環(huán)境污染犯罪的刑事立法來(lái)解決日益嚴(yán)重的環(huán)境污染問(wèn)題，已經(jīng)成為世界各國(guó)環(huán)境保護(hù)的發(fā)展趨勢(shì)。而我國(guó)由于環(huán)境污染犯罪刑事立法的缺失導(dǎo)致環(huán)境污染問(wèn)題不能得到及時(shí)的治理,因此非常有必要對(duì)我國(guó)的環(huán)境犯罪進(jìn)行立法完善。本文立足我國(guó)環(huán)境污染的現(xiàn)狀，指出我國(guó)環(huán)境犯罪的立法缺陷，在借鑒國(guó)外優(yōu)秀立法的基礎(chǔ)上，對(duì)我國(guó)環(huán)境污染犯罪的刑事立法提出完善建議。主要內(nèi)容如下： 第一部分是環(huán)境污染犯罪的概述。闡述了環(huán)境的概念，污染現(xiàn)狀、環(huán)境污染犯罪的概念、特征及刑法介入的必要性。第二部分是國(guó)外環(huán)境污染犯罪立法現(xiàn)狀的介紹，通過(guò)國(guó)外優(yōu)秀立法的分析，希望能對(duì)我國(guó)環(huán)境污染犯罪的刑事立法起到一定的啟示作用。第三部分是我國(guó)環(huán)境污染犯罪的立法現(xiàn)狀。主要是對(duì)我國(guó)環(huán)境污染犯罪立法進(jìn)程的介紹，闡述我國(guó)環(huán)境污染犯罪立法優(yōu)點(diǎn)和存在的缺陷。第四部分是環(huán)境污染犯罪的刑事立法完善。在分析了我國(guó)立法的不足的基礎(chǔ)上，，對(duì)我國(guó)環(huán)境污染犯罪的刑事立法完善提出一些建議。
[Abstract]:Environmental pollution has become a widespread concern in the world. On the basis of serious reflection on the current situation of environmental pollution, the governments of all countries are looking for an effective way to solve the problem of environmental pollution. At present, strengthening the criminal legislation of environmental pollution crime to solve the increasingly serious problem of environmental pollution has become the development trend of environmental protection in the world. However, due to the lack of criminal legislation on environmental pollution crime in China, the environmental pollution problem can not be dealt with in time, so it is very necessary to perfect the legislation of environmental crime in our country. Based on the current situation of environmental pollution in China, this paper points out the legislative defects of environmental crime in our country, and puts forward some suggestions to perfect the criminal legislation of environmental pollution crime in China on the basis of drawing lessons from foreign excellent legislation. The main contents are as follows: the first part is an overview of the crime of environmental pollution. This paper expounds the concept of environment, the status quo of pollution, the concept and characteristics of environmental pollution crime and the necessity of criminal law intervention. The second part is the introduction of foreign environmental pollution crime legislation, through the analysis of foreign excellent legislation, I hope it can give some enlightenment to the criminal legislation of environmental pollution crime in our country. The third part is the legislation status of environmental pollution crime in China. This paper mainly introduces the legislative process of environmental pollution crime in China, and expounds the advantages and disadvantages of the legislation of environmental pollution crime in our country. The fourth part is the improvement of criminal legislation of environmental pollution crime. On the basis of analyzing the deficiency of our country's legislation, some suggestions are put forward to perfect the criminal legislation of environmental pollution crime in our country.
