【摘要】：歷史上,我國曾深受煙毒之害,西方列強正是用鴉片和大炮打開了侵略中國的大門,從此中國人民就一直與毒品犯罪進行著不懈的斗爭。新中國成立后，黨中央憑借對社會的有效控制、強大的政權力量和廉潔、高效的干部隊伍，動員各種社會力量參與，領導全國人民開展聲勢浩大的禁毒斗爭，使困擾中國百余年的毒品問題得以解決,創(chuàng)造了舉世公認的“無毒國”奇跡。進入20世紀80年代，隨著改革開放的發(fā)展，境外、省外毒品憑借發(fā)達的物流交通加劇對遼寧“多頭滲透”，形成“南北夾擊”態(tài)勢，遼寧地區(qū)已從毒品犯罪主要走私通道和中轉站轉化為毒品的“消費地”，成為毒品的重要消費市場。當前，國內外關于毒品犯罪的研究論文、論著和專著很多，主要是針對理論方面研究的較多，實踐方面研究的較少；針對全國的毒品犯罪現(xiàn)狀及對策方面研究的較多，各省毒品犯罪現(xiàn)狀及對策方面研究的較少，尤其是針對遼寧地區(qū)毒品犯罪現(xiàn)狀與對策的研究顯得更少。對于全國的毒品犯罪研究現(xiàn)狀與對策分析基本上是概括性的，缺乏針對性；對各省毒品犯罪現(xiàn)狀及對策方面的研究，雖然具有針對性，但是由于域情、省情、毒情不同，又缺乏相應的指導性。因此，本文從遼寧打擊毒品犯罪歷史出發(fā)，通過調研總結當前遼寧毒品犯罪的總體情況，詳細分析毒品犯罪的特點和影響毒品犯罪發(fā)生的原因，，并進一步探索預防和遏制毒品犯罪的方法和對策，對于推進遼寧禁毒工作具有重要的現(xiàn)實意義。 本文主要由“遼寧省毒品犯罪狀況調查”、“遼寧省毒品犯罪特點分析”、“遼寧省毒品犯罪原因及其問題分析”、“遼寧省毒品犯罪預防對策”等四部分組成。 第一部分以概括敘述遼寧省打擊毒品犯罪歷史為切入點，以遼寧省各級人民法院2007年至2012年辦理毒品犯罪案件總體情況為立足點，重點分析了遼寧省毒品犯罪的案件數(shù)量特點、類型特點以及地域分布特點。第二部分主要分析總結了當前遼寧省毒品犯罪發(fā)展的突出特點，即一是毒品犯罪大要案不斷增多；二是毒品犯罪“南北夾擊、多頭滲透”的地域特征日趨明顯；三是毒品犯罪手段凸顯隱蔽化、現(xiàn)代化、武裝化；四是新型毒品犯罪案件明顯增多；五是特殊人群毒品案件不斷上升；六是毒品犯罪重刑適用率不斷提高。第三部分從影響毒品犯罪的刑事立法、經濟利益、社會環(huán)境、偵查環(huán)節(jié)、審判環(huán)節(jié)等方面出發(fā)，對遼寧毒品犯罪的成因進行分析，使我們從更深層次認識毒品犯罪現(xiàn)象,并掌握其規(guī)律。第四部分通過對遼寧毒品犯罪的現(xiàn)狀、特點及原因的分析,論文對遏制遼寧毒品犯罪提出相應對策：作者認為，預防和遏制毒品犯罪，必須牢牢控制住毒品的流通和消費這兩個環(huán)節(jié)，以完善立法、加強執(zhí)法、強化司法為重要手段，依賴社會各部門齊抓共管、綜合治理、防治結合，加大禁毒宣傳力度，加大打擊毒品犯罪力度，努力實現(xiàn)禁毒工作的健康科學發(fā)展。
[Abstract]:Since the founding of New China, the Central Committee of the Party has mobilized various associations through effective social control, powerful political power, honest and efficient cadres. In the 1980s, with the development of reform and opening up, drugs from outside Liaoning Province became more and more "multi-penetrating" with the aid of developed logistics and transportation. Liaoning has transformed from the main smuggling channels and transit stations of drug-related crimes into the "consumption areas" of drugs and has become an important drug consumption market. At present, there are many research papers and Monographs on drug-related crimes at home and abroad, mainly focusing on theoretical research and practical research. There are few researches on the current situation and Countermeasures of drug crimes in the whole country, less on the current situation and Countermeasures of drug crimes in various provinces, especially in Liaoning Province. Although the research on the present situation and Countermeasures of drug crimes in various provinces is pertinent, due to the differences in regional conditions, provincial conditions and drug conditions, there is a lack of corresponding guidance. Therefore, starting from the history of fighting drug crimes in Liaoning Province, this paper summarizes the overall situation of drug crimes in Liaoning Province, and analyzes in detail the characteristics of drug crimes and the influence of drugs. It is of great practical significance to promote the anti-drug work in Liaoning Province to find out the causes of drug-related crimes and further explore the methods and Countermeasures for preventing and curbing drug-related crimes.
This article mainly consists of four parts: the investigation of drug crime in Liaoning Province, the analysis of drug crime characteristics in Liaoning Province, the analysis of drug crime causes and problems in Liaoning Province, and the prevention countermeasures of drug crime in Liaoning Province.
In the first part, the history of cracking down on drug-related crimes in Liaoning Province is summarized as a breakthrough point. Based on the overall situation of drug-related crimes handled by the people's courts at all levels in Liaoning Province from 2007 to 2012, the number, types and geographical distribution of drug-related crimes in Liaoning Province are analyzed. The prominent characteristics of the development of drug crimes in Liaoning Province are: firstly, the number of major drug crimes is increasing; secondly, the regional characteristics of drug crimes are becoming more and more obvious; thirdly, the means of drug crimes are becoming concealed, modernized and armed; fourthly, the number of new drug crimes is increasing; fifthly, the number of special groups is increasing. The third part analyzes the causes of drug crimes in Liaoning Province from the aspects of criminal legislation, economic interests, social environment, investigation links, trial links and so on, so that we can understand the phenomenon of drug crimes in a deeper level and grasp its laws. The fourth part, through the analysis of the present situation, characteristics and causes of drug-related crimes in Liaoning Province, puts forward corresponding countermeasures to curb drug-related crimes in Liaoning Province. The author holds that to prevent and curb drug-related crimes, we must firmly control the circulation and consumption of drugs in order to improve legislation, strengthen law enforcement and strengthen justice as an important means and rely on society. All departments of the association should work together to jointly manage, comprehensively administer, combine prevention with control, intensify the propaganda of drug control, intensify the crackdown on drug crimes, and strive to realize the healthy and scientific development of drug control work.
