【摘要】：正虐待被監(jiān)護(hù)、被看護(hù)人罪,是指對(duì)未成年人、老年人、患病的人、殘疾人等負(fù)有監(jiān)護(hù)、看護(hù)職責(zé)的人虐待被監(jiān)護(hù)、看護(hù)的人,且情節(jié)惡劣的行為。對(duì)于本罪的理解與適用,重點(diǎn)要把握以下問(wèn)題:虐待被監(jiān)護(hù)、被看護(hù)人罪的侵害法益為被監(jiān)護(hù)人、被看護(hù)人的人身權(quán)。本罪主體為特殊主體,即只有對(duì)未成年人、老年人、患病的人、殘疾人負(fù)有監(jiān)護(hù)、看護(hù)職責(zé)的自然人和單位才能成為本罪主體。本罪的行為要素有如下幾方面:其一,違反(不履行)監(jiān)護(hù)或者看護(hù)義務(wù);其二,必須有虐待行為;其三,虐待行為必
[Abstract]:The crime of being under guardianship and being taken care of refers to the act of abusing the person under guardianship or nursing care to the minor, the elderly, the sick person, the disabled person, etc., and abusing the person under guardianship and nursing care, and the circumstances are abominable. For the understanding and application of this crime, the following problems should be grasped: abuse to be taken into custody, the violation of the law of the crime of being looked after as the personal right of the person under guardianship and the care of the person. The subject of this crime is a special subject, that is, only the natural persons and units who have the responsibility of guardianship and care for minors, the elderly, the sick and the disabled can become the subject of this crime. The elements of this crime are as follows: first, violation of guardianship or care obligations; second, there must be abuse; third, abuse must be committed.
