【摘要】：通過民事手段規(guī)制"流量劫持"行為,可以保護(hù)用戶自主使用權(quán)和市場(chǎng)正常經(jīng)營秩序。"流量劫持"嚴(yán)重破壞網(wǎng)絡(luò)安全,應(yīng)當(dāng)入罪處罰,可能構(gòu)成非法控制計(jì)算機(jī)信息系統(tǒng)罪、破壞計(jì)算機(jī)信息系統(tǒng)罪以及破壞生產(chǎn)經(jīng)營罪。提供"流量劫持"技術(shù)或幫助實(shí)施"流量劫持"也涉嫌構(gòu)成犯罪。"流量劫持"兼具非法控制和破壞行為的屬性,導(dǎo)致罪名之間出現(xiàn)競(jìng)合。對(duì)此,應(yīng)當(dāng)通過立法擴(kuò)大法益范圍與優(yōu)化行為類型加以化解,司法解釋和案例指導(dǎo)制度可以輔助解決。
[Abstract]:The regulation of "traffic hijacking" by civil means can protect the users' right to use independently and the normal operation order of the market. " Traffic hijacking "serious damage to network security, should be punished, may constitute illegal control of the computer information system crime, damage to computer information system crime and destruction of production and operation crimes." The provision of "flow hijacking" technology or assistance in the implementation of "traffic hijacking" is also suspected of constituting an offence. " Traffic hijacking has the attributes of illegal control and sabotage, which leads to a competition between charges. To solve this problem, we should expand the scope of legal interest and optimize the types of behavior through legislation, judicial interpretation and case guidance system can be assisted to solve the problem.
