【摘要】： 近年來,我國高校的職務(wù)犯罪現(xiàn)象已經(jīng)成為亟待研究和必須進(jìn)一步加以預(yù)防和遏制的重大問題。高校出現(xiàn)的職務(wù)犯罪,其影響廣泛而惡劣,危害嚴(yán)重而深遠(yuǎn)。因此,積極探索高校預(yù)防職務(wù)犯罪的新機(jī)制,加強(qiáng)預(yù)防高校職務(wù)犯罪工作,已經(jīng)成為事關(guān)高等教育快速健康發(fā)展的緊迫任務(wù)。 注重預(yù)防關(guān)鍵是要解決教育不扎實、制度不完善、監(jiān)督不得力的問題。本文從高校職務(wù)犯罪問題著手,分析當(dāng)前高校職務(wù)犯罪的特點(diǎn)及原因。在此基礎(chǔ)上,筆者認(rèn)為高校職務(wù)犯罪現(xiàn)象頻發(fā)的關(guān)鍵在制度本身不健全、落實也不到位。制度不落實,治本和預(yù)防都不可能收到明顯效果。加強(qiáng)對權(quán)力的制約和監(jiān)督,是有效預(yù)防職務(wù)犯罪的關(guān)鍵,也是治本的關(guān)鍵。這就要求必須深入探討以下幾個方面：了解我國高校內(nèi)部的行政體制,厘清學(xué)校與教育行政部門的關(guān)系；了解高校內(nèi)部財務(wù)管理運(yùn)行體系,尤其需要了解高校資金的分配、使用情況,以期提高高校資金的使用效率。最后參酌以上分析,提出建立預(yù)防高校職務(wù)犯罪機(jī)制的原則和舉措。
[Abstract]:In recent years, the phenomenon of duty crime in colleges and universities in our country has become an important problem that needs to be studied and must be further prevented and curbed. The duty crime in colleges and universities has a wide and bad influence and a serious and far-reaching harm. Therefore, it has become an urgent task for the rapid and healthy development of higher education to explore actively the new mechanism of preventing job-related crimes in colleges and universities and to strengthen the work of preventing job-related crimes in colleges and universities. The key to prevention is to solve the problem that education is not solid, system is not perfect and supervision is not effective. This paper analyzes the characteristics and causes of duty crime in colleges and universities. On this basis, the author believes that the key to the frequent occurrence of job-related crime in colleges and universities lies in the imperfection of the system itself and its implementation. The system does not carry out, cure the root cause and prevent can not get obvious effect. Strengthening the restriction and supervision of power is the key to effectively prevent duty crime, and also the key to cure the root of the disease. This requires the following aspects: to understand the internal administrative system of colleges and universities in China, to clarify the relationship between the school and the administrative department of education, to understand the operating system of financial management in colleges and universities, and especially to understand the distribution of funds in colleges and universities. Use of the situation, with a view to improving the efficiency of the use of funds in colleges and universities. Finally, taking into account the above analysis, this paper puts forward the principles and measures of establishing the mechanism of preventing duty crime in colleges and universities.
