面對(duì)網(wǎng)絡(luò)有害信息,刑法如何“亮劍”

【摘要】：網(wǎng)絡(luò)有害信息相關(guān)違法犯罪行為有其自身特點(diǎn),其往往借助網(wǎng)絡(luò)空間而具有更強(qiáng)的擴(kuò)散能力,同時(shí)具有傳播便捷性、主體隱蔽性、形式多樣性等特征,相關(guān)部門必須主動(dòng)出擊,積極應(yīng)對(duì),在堅(jiān)守刑法基本原則的基礎(chǔ)上拓展思路,勇于創(chuàng)新,提高網(wǎng)絡(luò)有害信息刑法規(guī)制的科學(xué)性、全面性,務(wù)求做到有法可依。
[Abstract]:The illegal and criminal behavior related to the harmful information of the network has its own characteristics, it often has stronger diffusion ability with the help of the network space, at the same time, it has the characteristics of communication convenience, subject concealment, variety of forms and so on, so the relevant departments must take the initiative to attack. We should actively deal with it, expand our thinking on the basis of adhering to the basic principles of criminal law, be bold in innovation, improve the scientific nature and comprehensiveness of the criminal law regulation of harmful information on the network, and make sure that there are laws to be followed.
