龍泉司法變遷及其對(duì)當(dāng)代中國(guó)基層刑事司法的借鑒

【摘要】：縣是國(guó)家治理的基本單位。國(guó)家對(duì)基層社會(huì)治理理念和治理方式的變遷也深刻地影響了基層法院的刑事司法運(yùn)作。以龍泉司法檔案為樣本分析晚清民國(guó)時(shí)期、建國(guó)初期、改革開(kāi)放至今三個(gè)階段刑事司法場(chǎng)域中國(guó)家與社會(huì)之間的關(guān)系,以期考察近代以來(lái)基層刑事司法的變遷邏輯與發(fā)展規(guī)律。對(duì)基層刑事司法治理模式的歷史梳理,為現(xiàn)代意義上刑事司法的國(guó)家治理與社會(huì)治理提供了經(jīng)驗(yàn)。
[Abstract]:County is the basic unit of national administration. The change of the concept and mode of the basic social governance has also profoundly affected the criminal judicial operation of the grass-roots courts. Taking the judicial archives of Longquan as a sample, this paper analyzes the relationship between the state and society in the criminal justice field in the three stages of the late Qing and the Republic of China, the initial period of the founding of the people's Republic of China, and the reform and opening up to the present, in order to investigate the logic of the changes and the law of development Combing the history of the criminal judicial governance model at the grass-roots level provides experience for the national and social governance of criminal justice in the modern sense.
