【摘要】：自《最高人民法院關(guān)于審理交通肇事刑事案件具體應(yīng)用法律若干問題的解釋》施行后,關(guān)于交通肇事罪指使逃逸共犯問題非議頻出。文章在闡釋交通肇事罪指使逃逸共犯問題相關(guān)概念后,通過對其條件簡析、辯證解讀,科學(xué)指出爭論背后的癥結(jié),最后提出了交通肇事罪指使逃逸共犯問題的完善路徑。
[Abstract]:Since the implementation of the Supreme people's Court's explanation on the specific application of the law in handling criminal cases of traffic accidents, the issue of directing escape accomplices on the crime of causing traffic accidents has come up frequently. After explaining the related concepts of traffic accident crime, this paper points out the crux of the argument scientifically by analyzing its condition, dialectical interpretation, and finally puts forward the perfect path of traffic accident crime directing escape accomplice.
