【摘要】：近年來，聚眾犯罪因其多發(fā)性以及巨大的社會危害性而備受刑法理論界與司法界關(guān)注。相關(guān)立法規(guī)定比較龐雜且不夠明確，也給理論研究和司法實踐帶來了諸多困惑，使得爭議不斷，造成了司法實踐中做法不一的混亂局面。因此有必要對聚眾犯罪的基本原理進(jìn)行認(rèn)真、深入的研究探討，用以指導(dǎo)司法實踐中具體案件的定罪量刑。 作者在細(xì)心研讀他人著作和學(xué)術(shù)成果的基礎(chǔ)上，結(jié)合我國立法現(xiàn)狀與司法實踐，選取了幾個有關(guān)聚眾犯罪的疑難問題進(jìn)行分析研究，以期對聚眾犯罪的研究和司法實務(wù)工作有所裨益。本文共分為五個部分： 第一部分：聚眾犯罪的內(nèi)涵辨析。簡要梳理了我國關(guān)于聚眾犯罪的立法概況，在此基礎(chǔ)上，通過分析對聚眾犯罪概念的不同觀點(diǎn)，從而得出了自己的觀點(diǎn)。 第二部分：聚眾犯罪與共同犯罪。本部分對聚眾犯罪與共同犯罪的關(guān)系、聚眾犯罪與必要共同犯罪的關(guān)系、聚眾犯罪的首要分子、積極參加者與主犯的關(guān)系以及聚眾犯罪的首要分子與組織犯的關(guān)系四個角度進(jìn)行了詳細(xì)闡述。 第三部分：聚眾犯罪的犯罪形態(tài)。聚眾犯罪經(jīng)常表現(xiàn)為復(fù)雜的共同犯罪，作者主要從首要分子的參與形態(tài)——實行犯與非實行犯兩個角度來進(jìn)行論述。 第四部分：聚眾犯罪的轉(zhuǎn)化犯。本部分首先分析了轉(zhuǎn)化犯的基本問題，在此基礎(chǔ)上進(jìn)一步分析聚眾犯罪轉(zhuǎn)化犯的共犯問題，主張全案轉(zhuǎn)化屬于聚眾犯罪的轉(zhuǎn)化犯，，部分轉(zhuǎn)化時則屬于共犯過限，應(yīng)當(dāng)實行罪責(zé)自負(fù)原則。
[Abstract]:In recent years, mass crime has attracted the attention of the criminal theory and the judiciary because of its frequent and enormous social harmfulness. The related legislative provisions are complex and not clear, but also to the theoretical research and judicial practice brought a lot of confusion, making disputes continue, resulting in different practices in the judicial practice of confusion. Therefore, it is necessary to study and discuss the basic principle of mass crime in order to guide the conviction and sentencing of specific cases in judicial practice. On the basis of careful study of other people's works and academic achievements, combined with the current situation of legislation and judicial practice in China, the author selected several difficult problems related to mass crime to be analyzed and studied. With a view to mass crime research and judicial practice of some benefit. This article is divided into five parts: the first part: the connotation of mass crime discrimination. This paper briefly combs the general situation of legislation about mass crime in our country, on the basis of which, through analyzing the different viewpoints on the concept of mass crime, the author obtains his own viewpoint. The second part: mass crime and joint crime. This part deals with the relationship between mass crime and joint crime, the relationship between mass crime and necessary joint crime, and the ringleader of mass crime, The relationship between active participants and principal offenders and the relationship between ringleaders of mass crime and organized crime are elaborated in detail. The third part: the crime form of mass crime. Mass crime is often manifested as complex joint crime. The author mainly discusses it from the angle of the participating form of ringleader-practicing crime and non-practicing crime. The fourth part: the transforming crime of gathering a crowd. This part first analyzes the basic problems of transformed crime, and then further analyzes the problem of accomplice of convergent crime of mass gathering crime, and argues that the whole case transformation belongs to the transformed crime of mass gathering crime, and part of the transformation belongs to the limitation of accomplice crime. The principle of guilt and responsibility should be applied.
