論我國對“伊吉拉特”恐怖活動犯罪的刑法規(guī)制

【摘要】："伊吉拉特"行為是我國跨境流動恐怖活動犯罪的常見形式,不光在國內(nèi)造成了嚴(yán)重危害,對國際社會同樣形成巨大威脅,具有刑事處罰的必要性。"伊吉拉特"行為雖然具有出境的外在表現(xiàn)形式,但因其不法與答責(zé)性程度遠(yuǎn)遠(yuǎn)超出偷越國(邊)境罪可能涵蓋的范圍,所以不應(yīng)當(dāng)以偷越國(邊)境罪的原刑法條文予以規(guī)制,《刑法修正案(九)》將該行為視為恐怖活動犯罪的預(yù)備犯,從而加重處罰,具有處斷上的合理性。
[Abstract]:"Ijarat" is a common form of cross-border movement of terrorist activities in China, not only causing serious harm in the country, but also posing a great threat to the international community, with the necessity of criminal punishment. " Although Ijarat's "behavior" has the external form of exiting the country, its illegality and responsibilityare far beyond the scope of the crime of crossing the border of the country (borderline). Therefore, it should not be regulated by the original criminal law provisions of the crime of crossing the border of the country (border). The amendment of the Criminal Law (9) regards the act as the preparatory offender of the crime of terrorist activity, thus aggravating the punishment, which has the rationality of judging the crime.
