【摘要】：猥褻兒童罪是指故意對(duì)兒童以除奸淫幼女之外的方式進(jìn)行性侵犯的行為。猥褻兒童罪不是傾向犯,刺激、滿足性欲是根據(jù)社會(huì)性觀念和兒童性禁忌的客觀判斷,而非行為人主觀動(dòng)機(jī)判斷。猥褻兒童與奸淫幼女的危害程度相近,一般應(yīng)定性為犯罪追究刑事責(zé)任。"聚眾或者在公共場(chǎng)所當(dāng)眾"之"當(dāng)眾"應(yīng)堅(jiān)守"當(dāng)著眾人面"文義,不應(yīng)過(guò)分?jǐn)U張解釋。刑法對(duì)猥褻兒童罪加重事由的規(guī)定脫離性侵兒童犯罪現(xiàn)實(shí),應(yīng)當(dāng)完善,增加"多人或多次"和"情節(jié)惡劣"的加重事由。
[Abstract]:The crime of child molestation refers to the intentional sexual assault of a child in a manner other than adultery. The crime of child molestation is not inclined to commit, stimulating and satisfying sexual desire is based on the objective judgment of social concept and child sexual taboos, rather than the subjective motive of the perpetrator. The degree of harm of child molestation and adultery is similar, so criminal liability should be investigated as a crime in general. " The "public" in public or in public should stick to the meaning of "in the presence of all" and should not be over-interpreted. From the reality of the crime of sexual assault against children, the criminal law should perfect and increase the aggravating reasons of "many persons or many times" and "bad circumstances" in the criminal law for aggravating the crime of child molestation.
