【摘要】：在刑法教義學(xué)中,如何通過(guò)法律解釋方法達(dá)成刑法的公正性與法益的安全性,這是一個(gè)亟待解決的問(wèn)題。其中,刑法的邏輯方法的正確運(yùn)用具有重要意義。這種刑法邏輯方法包括形式邏輯方法和實(shí)體邏輯方法。在認(rèn)定犯罪的時(shí)候,要進(jìn)行形式邏輯判斷和實(shí)體邏輯判斷。形式邏輯的判斷側(cè)重于對(duì)法條的形式特征的界定,尤其是涉及對(duì)法條之間邏輯關(guān)系的確定。而實(shí)體邏輯的判斷則偏向于對(duì)法條的實(shí)質(zhì)內(nèi)容的界定,尤其是對(duì)法條的內(nèi)容進(jìn)行價(jià)值考量。
[Abstract]:In the doctrine of criminal law, how to achieve the justice of criminal law and the security of legal interest by means of legal interpretation is an urgent problem to be solved. Among them, the correct application of the logical method of criminal law is of great significance. This kind of criminal law logic method includes formal logic method and entity logic method. In determining the crime, formal logic judgment and substantive logic judgment should be carried out. The judgment of formal logic focuses on the definition of formal characteristics of articles of law, especially on the determination of logical relations between articles of law. The judgment of substantive logic tends to define the substantive content of the article, especially the value of the content of the article.
