【摘要】：中國紀(jì)檢監(jiān)察學(xué)院李永忠教授曾經(jīng)在上世紀(jì)八十年代就預(yù)測過我國腐敗的發(fā)展趨勢，并將其劃分為三個(gè)層面：權(quán)錢交易、權(quán)色交易、權(quán)權(quán)交易。如今，第三個(gè)層面的腐敗新型式開始凸顯，即權(quán)權(quán)交易�！皺�(quán)權(quán)交易”具有嚴(yán)重社會(huì)危害性，它可以對任何權(quán)力存在的領(lǐng)域產(chǎn)生無窮的危害，造成公共利益的重大損失。這種嚴(yán)重的危害體現(xiàn)在兩個(gè)方面。一是，在行政權(quán)和行政權(quán)之間進(jìn)行交易的領(lǐng)域，權(quán)權(quán)交易行為一旦變得普遍，下層的人員很大程度上就減少了向上流動(dòng)的機(jī)會(huì)，整個(gè)社會(huì)的權(quán)力結(jié)構(gòu)就板結(jié)化了。二是，在行政權(quán)和司法權(quán)之間進(jìn)行交易的領(lǐng)域，就出現(xiàn)了較為嚴(yán)重的“以罰代刑”的局面。行政相對人的權(quán)力得不到保障，行政生效裁判的既判力得不到尊重，公民權(quán)利和行政權(quán)力失衡。 目前學(xué)界普遍將“權(quán)權(quán)交易”視為一種腐敗行為，有少數(shù)學(xué)者研究了個(gè)別類型的權(quán)權(quán)交易行為的犯罪構(gòu)成問題，但是不具有系統(tǒng)性，沒有從整體上對權(quán)權(quán)交易這類行為進(jìn)行犯罪學(xué)和偵查學(xué)上的深入研究�；诂F(xiàn)實(shí)需要，本文從以下幾方面對權(quán)權(quán)交易類職務(wù)犯罪進(jìn)行了研究： 文章一共分為四個(gè)部分。第一部分詳細(xì)介紹了權(quán)權(quán)交易的概念，權(quán)權(quán)交易類職務(wù)犯罪的概念，權(quán)權(quán)交易類職務(wù)犯罪的本質(zhì)特征和具體特征以及權(quán)權(quán)交易類職務(wù)犯罪的認(rèn)定問題。這部分內(nèi)容為全文起到一個(gè)奠定理論基礎(chǔ)的作用，最終明確了本文中權(quán)權(quán)交易類職務(wù)犯罪并不是作為一個(gè)法定罪名而是作為對權(quán)權(quán)交易這類行為構(gòu)成犯罪的統(tǒng)稱的基礎(chǔ)觀點(diǎn)。 文章的第二部分主要從經(jīng)濟(jì)、倫理、制度三方面剖析了權(quán)權(quán)交易類職務(wù)犯罪的形成原因。生產(chǎn)資料代表的獲得持續(xù)價(jià)值的能力以及信息租金的存在是權(quán)權(quán)交易類職務(wù)犯罪形成的經(jīng)濟(jì)條件；道德倫理的滑坡和道德標(biāo)準(zhǔn)的自我合理化過程也是權(quán)權(quán)交易類職務(wù)犯罪形成的原因；干部人事制度、權(quán)力監(jiān)督機(jī)制和法律制度的不完善是權(quán)權(quán)交易類職務(wù)犯罪最深層次的原因。這部分內(nèi)容是在前部分基礎(chǔ)內(nèi)容上的一個(gè)深入分析，也為下文第三部分內(nèi)容進(jìn)行鋪墊。 文章的第三部分主要論述了權(quán)權(quán)交易類職務(wù)犯罪偵查工作中的三個(gè)比較重要的環(huán)節(jié)。首先論述了檢察機(jī)關(guān)創(chuàng)新思維模式，建立“主動(dòng)型”犯罪線索收集模式的重要性。其次提出了要加強(qiáng)偵查信息化建設(shè)，形成以情報(bào)信息系統(tǒng)為前提，數(shù)據(jù)庫為重點(diǎn)，網(wǎng)上辦案系統(tǒng)為根本的全國性網(wǎng)絡(luò)平臺。最后還要注意把握好偵查取證問題上幾種關(guān)鍵性證據(jù)的提取問題，要結(jié)合權(quán)權(quán)交易犯罪行為特點(diǎn)，運(yùn)用好間接證據(jù)。這部分內(nèi)容是文章的重點(diǎn)之一，解決權(quán)權(quán)交易類職務(wù)犯罪的偵查重點(diǎn)問題才能為偵查實(shí)踐解圍。 文章的第四部分主要是針對權(quán)權(quán)交易類職務(wù)犯罪的成因總結(jié)了此類犯罪的防控對策。首先要在思想上堅(jiān)定法治的根本走向，直擊權(quán)權(quán)交易類職務(wù)犯罪存在的深層次的制度問題，實(shí)現(xiàn)制度的健全化和監(jiān)管的透明化。其次，要以信息建設(shè)為突破口，，實(shí)現(xiàn)權(quán)權(quán)交易類職務(wù)犯罪的“偵防一體化”。此外，還要加強(qiáng)對領(lǐng)導(dǎo)干部的思想道德教育，實(shí)現(xiàn)道德教育的制度化、常規(guī)化，形成長效機(jī)制。
[Abstract]:Professor Li Yongzhong of the China Discipline Inspection and Inspection Institute has predicted the development trend of corruption in China in the 1980s and divided it into three levels : power - money transaction , right - color trading and right - right transaction .

At present , it is generally regarded as a kind of corruption by a few scholars , but there are few scholars who have studied the crime structure of individual types of right - to - right trading behavior , but do not have systematicness and have not carried on the research of criminology and investigation on the behavior of right - to - right trading . Based on the practical need , this paper studies the duty crime of right - right trading from the following aspects :

The article is divided into four parts . The first part introduces the concept of right - to - right transaction , the concept of right - right trading , the essential characteristics and the specific characteristics of the duty crime of right - right trading , and the cognizance of the duty crime of right - right trading .

The second part of the article mainly analyzes the reasons for the formation of right - to - right trading - based duty crime from three aspects of economy , ethics and system . The ability of the representative of production information and the existence of information rent is the economic condition of the formation of right - right trading post - duty crime ;
The process of self - rationalization of moral ethics ' s landslide and moral standard is also the cause of the formation of right - to - right trading post - duty crime ;
The imperfection of the cadre ' s personnel system , the power supervision mechanism and the legal system is the most profound reason of the duty crime of the right to power transaction . This part is an in - depth analysis on the former part of the basic content , also the third part of the content .

The third part of this paper mainly discusses the three important links in the investigation of right - to - right transaction . Firstly , it discusses the importance of the innovative thinking mode of procuratorial organs and the establishment of the " initiative " crime clue collection mode .

The fourth part of the article is mainly to summarize the prevention and control countermeasure of such crime in view of the origin of the duty crime of right - right transaction . Firstly , we should strengthen the ideological and moral education of the leading cadres , realize the institutionalization of moral education , and form the long - term mechanism by strengthening the ideological and moral education of the leading cadres .
